Dear North Bristol NHS Trust,

This request for information is an attempt to seek reassurance about the safety of public buildings in the light of the findings revealed in the Inquiry commissioned following the collapse of a school building wall in Edinburgh and subsequent closure of 17 schools.
Please answer the following for each PFI/PPP schemes in your health trust treating each scheme as a separate request.
Please provide all documents showing how your organisation has responded to the findings contained in the report on Edinburgh Schools Construction by John Cole: including, but not limited to memos, emails, minutes, reports.
I would like to understand the expertise and resource committed by your organisation to the management and oversight of PFI schemes from procurement through to ongoing contract operation. Please provide documents relating to the PFI Team(s) allocated to each project its makeup and structure of the team during each project phase. This may comprise terms of reference, organisation chart, post titles and role profiles.
Provide the deed of appointment for the Independent Certifier and any other documents setting out the scope of that role. Please confirm the level of indemnity insurance and liability period.
Please confirm whether your organisation employed a member of the Institute of Clerk of Works or an inspector of similar standing and assigned them to each construction site. If someone in this role was employed please confirm their level of qualification, the salary associated with this role and how much time was allocated to per project/site.
Please provide a list of all enforcement or improvement notices served; investigations carried out and reports commissioned into fire safety (include dates and specify who commissioned or issued these) Please provide copies of all items listed.
Provide details of all attempts to make deductions relating to structural defects for each project. Confirm the amount, what it was for, and when the deduction was made.�

Thank you for your request for information of 5th June 2017. In compliance with the Freedom of Information Act 2000, our response is below and attached.

1) Please provide all documents showing how your organisation has responded to the findings contained in the report on Edinburgh Schools Construction by John Cole: including, but not limited to memos, emails, minutes, reports.

To the best of our knowledge there has been no directive from the Department of Health or any other organisation to undertake a review.

2) I would like to understand the expertise and resource committed by your organisation to the management and oversight of PFI schemes from procurement through to ongoing contract operation. Please provide documents relating to the PFI Team(s) allocated to each project its makeup and structure of the team during each project phase. This may comprise terms of reference, organisation chart, post titles and role profiles.

There are 3 organisations charts which indicate the team structures over a period of years to present day. The PFI operational personnel are highlighted in black text. Refer to documents attached.

3) Provide the deed of appointment for the Independent Certifier and any other documents setting out the scope of that role. Please confirm the level of indemnity insurance and liability period.

Attached is a redacted version of the agreement between North Bristol NHS Trust, Project Co and the Independent Tester. The following financial provisions have been redacted pursuant to the Section 43(2) exemption: Independent Tester’s total fee (page 638); (ii) the required minimum professional indemnity insurance (page 639); (iii) a schedule of draw-down of fees, and (iv) a schedule of daily rates for different categories of staff (pages 640 to 644). In Case No EA/2015/0022, the First Tier Tribunal confirmed that the public interest favoured maintaining the exemption.

The file is too large to send but can be sent in the post upon request.

4) Please confirm whether your organisation employed a member of the Institute of Clerk of Works or an inspector of similar standing and assigned them to each construction site. If someone in this role was employed please confirm their level of qualification, the salary associated with this role and how much time was allocated to per project/site.

In addition to the Independent certifier role, the Trust employed a Technical director to manage the reviewable design data (RDD), review construction progress and undertake post construction reviews. External Technical advisors were utilised as required.

5) Please provide a list of all enforcement or improvement notices served; investigations carried out and reports commissioned into fire safety (include dates and specify who commissioned or issued these) Please provide copies of all items listed.

We are not aware of any enforcement or improvement notices issued for Fire Safety.

“Following handover of the building there were several exploratory reports issued to the construction company to provide the Trust with assurance around Fire Safety, particularly in view of Department of Health interest in the subject in relation to PFI projects. In response the Project Co commissioned a Fire Engineering consultant to review the reports and provide a statement of assurance to the Trust on Fire Safety. The report regarding fire safety of the Brunel building indicates that the risk to life is ‘negligible to low’

6) Provide details of all attempts to make deductions relating to structural defects for each project. Confirm the amount, what it was for, and when the deduction was made.

No deductions have been made in relation to structural defects.
