Dear North Yorkshire County Council,

This request for information is an attempt to seek reassurance about the safety of public buildings in the light of the findings revealed in the Inquiry commissioned following the collapse of a school building wall in Edinburgh and subsequent closure of 17 schools.
Please answer the following for each PFI/PPP schemes in the local authority area treating each scheme as a separate request.
Please provide all documents showing how your organisation has responded to the findings contained in the report on Edinburgh Schools Construction by John Cole: including, but not limited to memos, emails, minutes, reports.
I would like to understand the expertise and resource committed by your organisation to the management and oversight of PFI schemes from procurement through to ongoing contract operation. Please provide documents relating to the PFI Team(s) allocated to each project its makeup and structure of the team during each project phase. This may comprise terms of reference, organisation chart, post titles and role profiles.
Provide the deed of appointment for the Independent Certifier and any other documents setting out the scope of that role. Please confirm the level of indemnity insurance and liability period.
Please confirm whether your organisation employed a member of the Institute of Clerk of Works or an inspector of similar standing and assigned them to each construction site. If someone in this role was employed please confirm their level of qualification, the salary associated with this role and how much time was allocated to per project/site.
Please provide a list of all enforcement or improvement notices served; investigations carried out and reports commissioned into fire safety (include dates and specify who commissioned or issued these) Please provide copies of all items listed.
Provide details of all attempts to make deductions relating to structural defects for each project. Confirm the amount, what it was for, and when the deduction was made.8

Council's response to the report undertaken by John Cole into the
Construction of Edinburgh Schools.

 

This report was commissioned by the City Of Edinburgh Council to consider
the specific circumstances associated with incidents arising in PFI
Schools in Edinburgh.  Although North Yorkshire County Council is aware of
the report and its recommendations it has not formally responded to it.

 

The County Council manages a single PFI contract which covers 4 separate
primary schools within the County, all of which were constructed during
the period 2001-2002.  The contract is managed via team comprising a
Property Contracts Officer, a Property Officer and an Accountant, all of
whom are based within the County Council's Strategic Resources
Directorate.

 

I regret that, having considered the County Council's electronic records
relating to the contract I have been unable to provide all of the
information that you have requested.  I have, however, requested that a
copy of the original file be retrieved from the County Council's archive
and will send a further response in the event that that information is
available.

 

However, please find attached: -

 

1.      A letter from EC Harris, acting as the Independent Tester, dated
18 March 2003, together with a Certificate of Availability and completion
certificates in respect of Kirby Hill C of E Primary School; and

 

2.      A Certificate of Availability in respect of Barlby Community
Primary School dated 3 May 2002

 

Where necessary we have removed names from the information disclosed to
you as we consider these to be personal data. As such we are withholding
this information under section 40 (2) of the Freedom of Information Act
2000 which exempts personal information from disclosure if disclosure
would breach one or more principles of the Data Protection Act 1998. In
this case we consider that disclosure would breach the first principle,
namely that personal information must be fairly and lawfully processed and
must meet one of the conditions for processing as provided by schedule 2
of the Act. In this case we consider that the disclosure would be unfair
and unlawful and none of the conditions for processing would be met.

I refer to my previous email in connection with your freedom of
information request and can confirm that I have now had the opportunity to
review the information that is held in the County Council’s records
storage in respect of the 4 schools that were provided via PFI.

 

I regret that I have not been able to locate the deeds of appointment for
the Independent Certifier for the schools that were not included in my
last response.  I can confirm, however, that E C Harris acted as the
Independent Certifier for the 4 school projects.  In fulfilling this role
E C Harris had a contractual obligation to maintain indemnity insurance of
£5 million, including for a period of 12 years after the completion of the
Certification of Services.
