Personalised Housing Plans

We're waiting for molly hood to read recent responses and update the status.

Dear Haringey Borough Council,

R(xy) v Haringey (2019) EWHC 2276 (Admin), clarified the legal position regarding action required to comply with s189a of the Housing Act, in that it was accepted that the duty to agree and review a Personalised Housing Plan remains until the s193 (main duty)is discharged. I am interested in finding out how legally compliant the Council is.

Please advise the following:

1. How many main duty acceptances have there been since April 2018. Please break this down by month ending Oct 2020.

2. Of these, how many have had a post-s193 acceptance Personalised Housing Plan. Again please break down by month. I am not interested in any plan agreed before the main duty decision, only those issued subsequently, and only require data for those issued that comply with the legislation (correct notification and format).

3. Of those at number 1, how many have had a review of the Personalised Housing Plan issued subsequent to main duty decision. As per question 2 I only require data for those issued that comply with the legislation)

4. Please provide a copy of the internal procedure used by staff regarding completion of post -s193 Personalised Housing Plans.

5. Please advise by month the number of Applicants who have disagreed with the actions in the Personalised Housing Plan issued post-s193 decision.

6. If the Council has not been compliant with the legislation, and there are any main duty cases who have not been issued with a post-s193 Personalised Housing Plan, please share copies of any internal emails (names redacted if need be) where the matter has been brought to the attention of the Senior Management Team at the Council or the Monitoring Officer.

7. Please provide the name and contact details of the Council’s Monitoring Officer.

from April 2018. Whilst the assessments were detailed in documenting
household requirements, Personalised Housing Plans were introduced as part
of the assessment in December 2019. Staff are required to send copies of
the PHP to the customer.

Seven households have had reviews of their PHPs since December 2019.

This is not recorded. However, we are unaware of any household who has
disagreed with the actions agreed with them.  

 

6. If the Council has not been compliant with the legislation, and there

(names redacted if need be) where the matter has been brought to the
attention of the Senior Management Team at the Council or the Monitoring

PHPs were not introduced until December 2019. As a matter of course,
assessments are carried out once duty has been accepted and when contact
is successfully made. No breaches have been reported to the Council.

Dear Haringey Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Haringey Borough Council's handling of my FOI request 'Personalised Housing Plans'.

Not all questions have been answered. I requested name of monitoring officer.

The legislation required this work to have been done since April 2018, yet response says done since Dec 2019. This would imply that the LA was not legally compliant. Is this the case? Has this been reported to monitoring officer?

The attached ‘procedure’ is dated 25/11, please advise what was in use from April 2018.
