Dear Scottish Prison Service,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Scottish Prison Service's handling of my FOI request 'Personal Communication Devices Discovered in Prisons 2011-2022'.
RFI4, RFI5, and RFI6 have been refused based on section 34 of the FOISA. These requests relate simply to the cumulo numbers of the specified recovered devices, in each prison, which have been reported for prosecution. Section 34 exempts information that has at any time been held by the SPS for the purposes of an investigation or criminal proceedings. This section properly excludes information so held, that if made public could prejudice such individual investigations or proceedings. Such cumulo numbers are however patently not information held for the purposes of, being entirely irrelevant to, any such individual investigations or criminal proceedings for which this exemption has application. I would therefore be grateful if this decision could be reviewed.
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/p...
Yours faithfully,
Yibing Zhang
