Dear Cleveland Fire Brigade,

Please can you tell me if you have complied with the above court
ruling relating to additional payments paid to Firefighters e.g.
Day Crewing, Training Allowances etc now being classed as
pensionable pay?

Freedom of Information Request

 

I am writing further to your email of 15th October 2015 where you
requested the following information:

 

 

Please can you tell me if you have complied with the above court ruling
relating to additional payments paid to Firefighters e.g.

Day Crewing, Training Allowances etc now being classed as pensionable pay?

 

1. If yes, when did you comply with this ruling?

 

2. If no, why haven't you complied with this ruling?

 

Following the judicial review in 2011 (Norman v Cheshire Fire and Rescue
Service) it was identified that any allowance paid in accordance with the
Day Crewing Plus Duty System should be regarded as pensionable.  Cleveland
Fire Brigade has no staff to whom this applies as we do not operate the
day crewing system.  

 

You have the right of appeal against the decision. If you wish to appeal
please set out in writing your grounds of appeal and send to the Head of
ICT, at the address below or email [1][Cleveland Fire Brigade request email]

 

Appeals or reviews should be made within 40 working days of our response
to your request being issued.  Any appeals or requests for review received
outside of the 40 working days will be refused.  Please note this is in
line with the Information Commissioner’s own working practices.

 

If you are not content with the outcome of your complaint, you may apply
directly to the Information Commissioner’s Office (ICO) for a decision. 
Generally, The ICO cannot make a decision unless you have exhausted the
complaints procedure provided by Cleveland Fire Authority.  The ICO can be
