Penalty Notices and Prosecution of parents in relation to unauthorised absence from Wood Green Academy

Dear Wood Green Academy, Wednesbury,

I am interested in information pertaining to the sanctions issued to parents of pupils at Wood Green Academy, WS10 9QU; including, a Parenting Order, an Education Supervision Order, a School Attendance Order, a Penalty Notice or Prosecution issued under s444 of the Education Act 1996.

Penalty Notices are fines of £60/£120 (currently) imposed on parents individually. Penalty notices can be used where the pupil’s absence has not been authorised by the Academy. They can only be issued by a Head Teacher or someone authorised by them (a Deputy or Assistant Head), a Local Authority Officer or the Police. The notices should include details of the circumstances which triggered the notice. All Academies and the Police must send copies of penalties issued to the Local Authority.

A Summons is issued if the Academy intends to prosecute under Offence s444(1) or Offence s444(1A). If found guilty at Magistrates court, a fine of up to £1000 may be imposed, as well as costs for Offence s444(1), and a fine of up to £2,500 as well as costs and/or a term of imprisonment not exceeding three months may be imposed for Offence s444(1A).

My questions are set out below:

1. What is the name(s) of the person(s) responsible within the Academy for issuing Penalty Notices to parents, where a pupil's absence has not been authorised by the Academy?

2. How many Penalty Notices have been issued in the last five academic years, including the current year? Please provide figures per academic year.

3. Of the Penalty Notices issued in the last five academic years, how many were paid within 21 days; and how many were paid outside the 21 day period?

4. What is the total revenue from Penalty Notices over the last five academic years, including the current year? Please provide figures per academic year.

5. Please provide an electronic copy of the internal process and procedure, policy or code of practice followed, leading to the issuing of a Penalty Notice?

6. What is the name(s) of the person(s) responsible within the Academy for making the decision to proceed to prosecution of parents, where a pupil's absence has not been authorised by the Academy?

7. Please provide the total number of prosecutions in the last five academic years, including the current year, identifying whether the prosecution was brought under s444(1), or s444(1A)?

8. Please provide an electronic copy of the internal process and procedure, policy or code of practice followed leading to the issuing of a Summons to a parent in consideration of prosecution under either s444(1) or s444(1A)?

9. How many parents have been successfully prosecuted under S444(1) and s444(1A) in the last five academic years, including the current year?

10. What is the total revenue from fines imposed following prosecution under S444(1) and s444(1A) over the last five academic years, including the current year? Please provide figures per academic year.

11.Finally, how many Parenting Orders, Education Supervision Orders, and School Attendance Orders have been imposed on parents in the last five academic years, including the current year? Please provide figures under each type of order per academic year.
