Pedestrian subway

Signage within the subway at the junction of Whitechapel High Street, Mansell Street, Aldgate High Street and St. Botolph Street would imply that the subway is operated and controlled by the London Borough of Tower Hamlets. I am of the understanding that part of the subway is located in Tower Hamlets and part of the subway is located in the City of London.

I require the following information:

1. What arrangement exists between the London Borough of Tower Hamlets and the Corporation of London that give Tower Hamlets the duty to operate and maintain the subway? Please supply a copy of any written agreement.

2. Is any payment made by the Corporation of London in consideration of Tower Hamlets operating and maintaining the subway? Please confirm the annual amount of the payment.

3. The toilets in the subway appear to be operated by the Corporation of London. Does the Corporation pay rent to the London Borough of Tower Hamlets for its occupation of this part of the subway? Does the London Borough of Tower Hamlets pay the Corporation of London for provision of a service within the subway? Please confirm the annual amount of the payment.

4. Who is the registered proprietor of the subway?

Your request for information has been considered under the requirements of the Freedom of Information Act and the information is below. I apologise for the delay in providing this response.

Signage within the subway at the junction of Whitechapel High
Street, Mansell Street, Aldgate High Street and St. Botolph Street
would imply that the subway is operated and controlled by the
London Borough of Tower Hamlets. I am of the understanding that
part of the subway is located in Tower Hamlets and part of the
subway is located in the City of London.

I require the following information:

1. What arrangement exists between the London Borough of Tower
Hamlets and the Corporation of London that give Tower Hamlets the
duty to operate and maintain the subway? Please supply a copy of
any written agreement.

The Aldgate pedestrians subways where originally built by the London County Council, (L.C.C.) as part of a major redevelopment of the Aldgate High Street, St Botolph Street & Whitechapel High Street area.

The ownership of the pedestrian subways where then transferred to the Greater London Council, (G.L.C.), which were again transferred in 1986 following the abolition of the G.L.C to both the Corporation of London & the London Borough of Tower Hamlets.

2. Is any payment made by the Corporation of London in
consideration of Tower Hamlets operating and maintaining the
subway? Please confirm the annual amount of the payment.

In August 2000 an agreement between the CofL & LBTH was signed, (copy attached), whereby LBTH would act as the maintaining agent on behalf of the CofL for the pedestrian subways under both Middlesex Street & St Botolphs Street, including the access ramps & stairs. The agreement also includes a copy of the maintenance schedule, plus an anticipated annual cost of £5750.

3. The toilets in the subway appear to be operated by the
Corporation of London. Does the Corporation pay rent to the London
Borough of Tower Hamlets for its occupation of this part of the
subway? Does the London Borough of Tower Hamlets pay the
Corporation of London for provision of a service within the subway?
Please confirm the annual amount of the payment.

Although the maintenance of both Middlesex Street & St Botolphs Street pedestrian subways where transferred to LBTH the ownership of the subways, including the toilets, was not part of the transfer agreement & remained with CofL, therefore any request for information regarding the payments of rent should be referred to CofL.

4. Who is the registered proprietor of the subway?

Finally for your information following the creation of the Greater London Assembly in the summer of 2002 & the subsequent formation of Transport for London, (TfL), the pedestrian subways that where owned & maintained by LBTH where then transferred to TfL.
