Payments to Moirai Capital Investments

Dear East Devon District Council,

I make this request under the FOI Act and Environmental regs

We have learned from local press reports that EDDC has ended the status of Moirai Capital Investments as preferred partner in relation to the regeneration of Exmouth.

Has council made any payments to Moirai, or any agent on their behalf (JLL?) and if so, what are the details.

What meetings have been held with Moirai or any of it's agents and what officer time or other costs have been incurred. Full details please , to include dates, place of meeting and officers/members meeting.

Is it correct that EDDC has been taking councillors (and any others e.g regeneration panel members) to view Moirai's Swindon operation? Full details please.

When did EDDC decide to end it's preferred partner relationship with Moirai and why? please supply full reasons and dates with copies of reports and decisions .

Please explain what has changed, other than the passage of time, that necessitates a rethink on regeneration proposals.

Please ensure that the fullest details are given in response together with copies of all relevant paperwork, emails etc.

19 September 2014. Meeting with Moirai.
24 Feb 2015. Meeting with Moirai and JLL (agent to EDDC)
24 April 2015. Meeting with Moirai and JLL. Held at JLL offices.
27 May 2015. Meeting with Moirai and JLL. Held at JLL offices
16 June 2015. Meeting with Moirai and WSP (engineering consultants to EDDC).
6 August 2015. Meeting with Moirai and JLL and also a meeting with Moirai .

We do not hold information regarding officer cost.

Details of visit made by EDDC Councillors to view Moirai's Swindon operation
Saturday 3rd October 2015 - A trip was arranged to visit the Oasis Leisure centre in Swindon with 6 Exmouth town councillors.

Details of EDDC's decision to end its preferred partner relationship with Moirai including dates and copies of reports and decisions
There is no information held. Any formal decision will be documented in the minutes of Cabinet which will be available online.

Thank you for this part- reply to my request.

You have met my request for full details in some respects but have not included the location of some meetings, nor the persons present, in most. Please address fully and also confirm, or otherwise, whether any meetings were held in Moirai offices or not. (if so where)

In addition I asked for fullest details to include copies of all relevant paperwork and emails etc but no such copies have been provided. As you have not claimed that such documents are exempt, exemption cannot be an obvious protectection afforded to them. Please supply in full as requested.

I also asked about the 'rethink' on regeneration proposals but you say that 'no information is held'. This clearly cannot be so . It may be that EDDC fails to comply with the Ombudsman's decision of 20th January 2004, where he instructs council to keep a writen record of decision making, but there must be some information within the council. May I quote Councillor Phillip Skinner, the new chairman of the Exmouth Regeneration program who, in an interview published in the Journal on 4th August said "we are going to retender, and it doesn't mean to say that Moirai won't come baack into the field and have a crack at it". Either it has always been the intention of EDDC to have a retender (which begs many other questions) or they have had a rethink and EDDC must therefore hold some information.
Please decide which of the options above applies and provide a clear and unambiguous response to my question on the 'rethink'/retender question.
A full and proper response to my initial FOI should have been provided within the time permitted by the Acts. EDDC has had 20 working days to consider and prepare it's response but has failed to provide a complete response. Please expedite the response to my request for full information.
