Dear Brighton and Hove City Council,

You state that Ethical Parking Management Ltd ceased trading. This is incorrect. Ethical Parking Management Ltd changed their name to One Parking Solution on 7th May 2015, according to Companies House. Both company names have the same company number.

However, BHCC's contract with Ethical Parking Management continued until 30th November 2017, when BHCC issued a Deed of Variation, changing the contractor name from Ethical Parking Management Ltd to One Parking Solution.

Please could you provide the previously requested information.

I am writing to request an internal review of Brighton and Hove City Council's handling of my FOI request 'Parking Charge Notices issued by One Parking Solution in 2016'.

You state that this information is not available, however this is contradicted by another of your FOI replies, which states that the PCN income received by BHCC from Ethical Parking Management Ltd / One Parking Solution between 4/9/2015 and 14/8/2017 was £17485.42, this being 13% of the value of paid PCNs.

Thank you for your internal review request of 09 December 2021 in relation
to your Freedom of Information Act request regarding One Parking Solution
which we received on 08 November 2021.  We apologise for the severe delay
in responding to your internal review request and for any inconvenience
this may have caused.

We have now processed your request and can confirm that we don't uphold
your complaint.  

Your request and our response are below:

 

Your request

 Your request of 08 November 2021 stated the following:

'Dear Brighton and Hove City Council,

Our initial response

On 09 December 2021, we responded stating that this information was not
held.  

 

Your internal review request

 On 09 December 2021, you submitted the following email:

'You state that Ethical Parking Management Ltd ceased trading. This is
incorrect. Ethical Parking Management Ltd changed their name to One
Parking Solution on 7th May 2015, according to Companies House. Both
company names have the same company number.

However, BHCC's contract with Ethical Parking Management continued until
30th November 2017, when BHCC issued a Deed of Variation, changing the
contractor name from Ethical Parking Management Ltd to One Parking
Solution.

Please could you provide the previously requested information .'

 

Our internal review response

 In processing your internal review request we contacted Housing and One
Parking Solution (OPS). Our internal review response below is based on
information provided to us by OPS in relation to your request.

One Parking Solution (OPS) have stated that if the information was held,
they would have no concerns about sharing this information as it would be
statistical and anonymised. However, OPS do not hold information this far
back. OPS have stated that the contract was with fewer sites than the
current contract and that they were nearly all Brighton and Hove City
Council residential sites.

In relation to the 2016 information (the information being requested),
this information has been destroyed.  OPS is a member of an ATA
(Accredited Trade Association), and as such has access to certain DVLA
(Driver and Vehicle Licensing Agency) vehicle data but only under strict
guidelines and OPS are regularly audited by the DVLA for compliance.

Unless a PCN (Penalty Charge Notice) remains unpaid, OPS can only hold
keeper data for up to two years once the process is completed and this is
for DVLA auditing purposes. If a PCN remains unpaid it can pursue it for
up to 6 years from last contact or until the debt is statutorily barred in
law.

With Ethical Parking Management becoming One Parking Solution Ltd, subject
to the above, all data has been purged. The only data kept by OPS from
those dates is financial data which is commercially sensitive. The terms
of the OPS DVLA KADOE (Keeper at Date of Event) contract also specify
anonymising data going forward which OPS does.

One Parking Solution Ltd (05992210) was established on November 8th, 2006,
as Guardian Parking Management Ltd. It went through several name changes
over the years becoming Ethical Parking Management Ltd on 27th March 2008.

From that time, the company acquired several smaller companies and had to
consolidate by changing its name to One Parking Solution Ltd on 7th May
2015, trading as Ethical Parking Management. This change was made due to
the limitations of the then, only available bespoke software, which was
limited to processing PCNs, under just one company name.

On 25th February 2016, OPS changed the name of a dormant sister company,
Premier Plus Training Ltd established on 23rd January 2004, to Ethical
Parking Management Ltd (05024823) to safeguard the name 'Ethical Parking
Management' from use by others. That company is not trading.

 

 We will now close your internal review request as of this date.

the right to apply directly to the Information Commissioner's Office for a
