Dear Cambridge City Council,

In relation to the ice-rink and associated attractions on Parker's Piece during the winter of 2015-16 please release:

* The amount due to the council under the profit share agreement along with any information provided to the council showing how the amount due was calculated.

* The amount of any payments to the council promised by the operator outside of the profit share specifically in relation to the damage caused to the grass.

* The amounts of any payments the operator has informed the council it has made to those other than the council in relation to efforts to restore the area following the damage caused to the grass.

* The amount actually paid by the operator to the council to-date.

Further to your recent Freedom of Information request as follows: --

 

Information requested:

 

In relation to the ice-rink and associated attractions on Parker's Piece
during the winter of 2015-16 please release:

 

a The amount due to the council under the profit share agreement along
with any information provided to the council showing how the amount due
was calculated.

 

b The amount of any payments to the council promised by the operator
outside of the profit share specifically in relation to the damage caused
to the grass.

 

c The amounts of any payments the operator has informed the council it has
made to those other than the council in relation to efforts to restore the
area following the damage caused to the grass.

 

d The amount actually paid by the operator to the council to-date.’

In response to your request:-

 

a              The Fee related to ground rent to the Council for the
2015/2016 Event shall be £25,000 paid as follows:

 

50% of the total profit (where profit equates the total net income after
payment of all direct costs for the Event) until £20,000 has been secured
by the Council, thereafter the Council shall receive 30% of any further
profit until a further £5,000 has been received (equating to a maximum fee
of £25,000).

 

The fee must be paid by the Organiser to the Council no later than 28th
February each year. 

 

The Fee related to ground rent for each subsequent year shall be paid as
follows:

50% of the total profit (where profit equates the total net income after
payment of all direct costs for the relevant Event) from the relevant
event shall be paid to the Council up to a maximum amount of:

 

2016/2017 £30,000

2017/2018 £35,000

2018/2019 £40,000

2019/2020 £45,000

 

b)            £7600

 

c)            None

 

d)            We have considered this request and it is our intention not
to disclose the net income as we have applied Section 43 of the Freedom of
Information Act which sets out an exemption from the right to know, if
release of the information is likely to prejudice the commercial interests
of any person.

We believe that in doing so, disclosing the net income would prejudice the
Ice Box operation of North Pole; and this is because competitors would be
made aware of the financial contribution made to the Council.

We have applied a public interest test to establish if we are content that
the information requested would prejudice someone’s commercial interests,
and believe that disclosure would have a negative impact on the ongoing
improvement discussions about the North Pole Hire Agreement.

We can only refuse to provide the information if it is satisfied that the
public interest in withholding the information outweighs the public
interest in disclosing it.   We believe it is in the best financial
interests of the Council and therefore the public interest, not to alert
contractors likely to compete from future contracts the current financial
model of Ice Box.

 

If you are dissatisfied with our response, you are entitled to ask for a

In their reply the Council says

"We believe it is in the best financial interests of the Council and therefore the public interest..."

Is that really what "public interest" means? That could be used to hide all sorts of things that might cost the Council money.

eg "Spending time answering FoI requests costs money that could be better spent on something else. This isn't in the best financial interest of the Council so all requests are refused."
