In response to your Freedom of information request number 00568, in which
you asked the following
Please provide all documentation that describes the reasons as to why the
recently built park next to Artillery Avenue, near ASDA's on the A13 in
Shoeburyness has not been opened to the public to date.
I can confirm that a search for the information has been completed.
Unfortunately the information requested is exempt under Section 21 of the
Freedom of Information Act ‘Information Accessible to applicant by other
means’. Planning Files are covered under the Local Government Access to
Information Act 1985 and are public documents. Therefore you can view and
search all planning applications online at
[1]www.southend.gov.uk/publicaccess. You can also view hard copy planning
files at the Civic Centre, Victoria Avenue, Southend by making an
appointment on 01702 215004. However I have attached the document that
provides the information you require, Para 1 of Schedule 1.
The park is "required to be made available for public use by not later
that the Occupation of the last of the remaining units". So if the last
remaining unit has still yet to be occupied then they are not in breach of
the requirement.
If you are unhappy with the service you have received in relation to your
request and wish to make a complaint or request a review of our decision,
you should write to Complaints Officer, Support Services Department, PO

Unfortunately the Council does not hold that information, you would need
to refer your question to the Agent managing the units. However, the
Council are aware parts of the development are still under construction.
