Parish Council Minutes and Nominations of 82 & 82b Lower Street.
Dear Ms Martin
A number of queries have arisen out of SPC's response of 17.12.20. To prevent confusion with the review process for the previous FOI, I now submit a separate FOI to seek clarification of the nominations of 82 & 82b Lower Street as retrospectively recorded in the Parish Council Minutes of 3.4.17.
On the 3.4.17 the following is recorded in the minutes:
"Item 6. Matters arising not on this agenda:
Radleys ACV has been submitted – Vince Tapp explained the process
Prima Rosa ACV to be completed and submitted"
This retrospective minute records that the parish council had already identified and resolved to nominate both Prima Rosa [82 Lower Street] and Radley's [82b Lower Street] for ACV's. This minute records that whilst two properties were identified for ACV nominations, only one ACV nomination application was completed and submitted prior to the parish council meeting of 3.4.17.
[Please note the ACV nomination for Radley's at 82b Lower Street was signed and dated 22.3.17 and electronically submitted on 24.3.17].
The retrospective record of 3.4.17 meeting also reflects that whilst the parish council had agreed to nominate both Radley's & Prima Rosa at 82 & 82b Lower Street for ACV's in 2017, the council agreed not submit an ACV nomination for Prima Rosa at 82 Lower Street .
[Please note the ACV nomination for Prima Rosa at 82 Lower Street was not submitted until two years later].
Nevertheless, I have searched and searched the parish council minutes and cannot find any record of SPC meeting (as a body corporate) where councillors have legally proposed/seconded and resolved by show of hands to nominate both Prima Rosa at 82 Lower Street & Radley's at 82b Lower Street for ACV's.
I have also searched the parish council minutes and cannot find any record of the SPC meeting (as a body corporate) where councillors have legally proposed/seconded and resolved by show of hands to hold back and NOT to complete and submit a nomination for Prima Rosa at 82 Lower Street whilst simultaneously agreeing and resolving to ONLY submit its nomination for Radley's.
Without confirmation and evidence of the legal resolutions by SPC the actions reported by Cllr Tapp at the 3.4.17 remain 'ultra vires'.
Therefore, to confirm this is not the case, I request the following:
1. A copy of all 2017 documents, minutes of meetings, meeting notes, memos, emails, letters, notes of phone conversations between SPC councillors/District Councillors and the clerk of SPC where the parish council discuss and identify ACV nominations for Prima Rosa & Radley's at 82 & 82b Lower Street.
2. A copy of all 2017 documents, minutes of meetings, meeting notes, memos, emails, letters, notes of phone conversations between SPC councillors/District Councillors and the clerk of SPC that give instructions the clerk to submit the ACV nomination to Broadland District Council for Radley's at 82b Lower Street in March 2017.
3. A copy of all 2017 documents, minutes of meetings, meeting notes, memos, emails, letters, notes of phone conversations between SPC councillors/District Councillors and the clerk of SPC that instruct the clerk to withhold or not complete and submit the ACV nomination for Prima Rosa at 82 Lower Street in March 2017.
4. If the clerk and council was instructed and/or advised by BDC to submit a nomination outside a resolution of council, please provide all documentation that supports the nomination and submission of 82b Lower Street as an ACV on 23.4.17.

Dear Salhouse Parish Council Clerk,
I am writing to request an internal review of Salhouse Parish Council's handling of my FOI request 'Parish Council Minutes and Nominations of 82 & 82b Lower Street.'
In particular I refer to the one and only document released under this request:
"A copy of all 2017 documents, minutes of meetings, meeting notes,
memos, emails, letters, notes of phone conversations between SPC
councillors/District Councillors and the clerk of SPC that give
instructions the clerk to submit the ACV nomination to Broadland District
Council for Radley's at 82b Lower Street in March 2017."
The content of this one email highlight that other correspondence exist and they are referenced within the short email. The email highlights discussions of prior decisions or lack thereof that lead to the instruction given to the clerk. Other documents related to this email, clearly exist and I request a review of the FOI.
The FOI also states "Please see attached a redacted copy of an email from the Chairman of
Salhouse Parish Council". Please clarify which Chairman this refers to the current Chair or the recently resigned Chair or the Chair in office in 2017 which this email was written?
