There are no performance KPI’s in the contract.

 

 2. Suppliers who applied for inclusion on each framework/contract and
were successful & not successful at the PQQ & ITT stages.

 

The successful bidder was National Youth Advocacy Service.

 

The following information has not been disclosed to you:

 

 1. The names of the unsuccessful bidders.

 

The Council considers that this information is exempt from disclosure
under section 43 of the Freedom of Information Act 2000 (“FOIA”).  Section
43(2) stipulates that information is exempt from disclosure if:

 

 1. Its disclosure would or would be likely to prejudice the commercial
interests of any person.

 

In this case, the Council considers that, if this information were
disclosed to you, it would be likely to prejudice the commercial interests
of those bidders that were unsuccessful in bidding for the contract and
disclosing could help their competitors and discourage them from bidding
for future tenders.

 

In reaching this decision, the Council was obliged to consider the Public
Interest Test (PIT); in doing so, it reached the conclusion that it was in
the public interest to maintain the exemption under section 43 and
withhold the information.  The following arguments were considered as part
of the PIT:

 

Arguments in favour of disclosure

 

 1. Releasing this information may promote transparency and increase
public awareness in the Council’s decision-making processes.

 

Arguments against disclosure

 

 1. Disclosing information about a third party’s pricing structure into
the public domain would be likely to impart an unfair commercial
advantage on its competitors and
 2. Disclosure of the prices that the Council pays for contracted services
would be likely to adversely affect any future contracting process in
that any bids made by third parties could mirror the disclosed
prices.  It is in the public interest for the Council to obtain value
for money and thus ensure that the appropriate contracting processes
invite blind, and therefore competitive bids from third parties; and

 

Having considered these arguments, the Council considers that the public
interest in withholding the information outweighs the public interest in
disclosing it.  Consequently, this information will not be released to
you.

 

 

 3. Actual spend on this contract/framework (and any sub lots), from the
start of the contract to the current date

 

£499,580.06 to date.

 

 

 4. Start date & duration of framework/contract?

 

1st October 2019 Duration 42 months

 

 5. Could you please provide a copy of the service/product specification
