Freedom of Information, Lancashire County Council

Dear Mr. Cranidge-Philips

Request for information under the Freedom of Information Act 2000

We refer to your request for information, made under the provisions of the
above Act. Please see below our response.

Request:

I would be most grateful if you would let me have the wording that LCC
includes in its policies and / or contracts with suppliers about what to
do if they receive an over payment from yourselves.

Response:

Our standard Care Contract includes the following wording:

28.6        If an audit identifies that:

(a)       the Service Provider has failed to perform its obligations under
this agreement in any material manner, the parties shall agree and
implement a remedial plan. If the Service Provider's failure relates to a
failure to provide any information to the Authority about the Charges,
proposed Charges or the Service Provider's costs, then the remedial plan
shall include a requirement for the provision of all such information;

(b)       the Authority has overpaid any Charges, the Service Provider
shall pay to the Authority the amount overpaid within [NUMBER OF DAYS]
days. The Authority may deduct the relevant amount from the Charges if the
Service Provider fails to make this payment; and

(c)       the Authority has underpaid any Charges, the Authority shall pay
to the Service Provider the amount of the under-payment less the cost of
audit incurred by the Authority if this was due to a default by the
Service Provider in relation to invoicing within [NUMBER OF DAYS] days.

We hope the above is informative.

Should you require anything further, please do not hesitate to contact the
Team.

Yours Sincerely,

On Behalf of the Information Governance Team
