Clarification of request

 

Please note that the Council cannot accept your request because it is not
clear what incidents you are referring to.  The Out of Hours service
receive many calls on each of the dates you have specified.  Please either
rephrase your request or supply more detail about the information that you
want, for example, if you reported these incidents please provide any
related reference numbers. 

 

As soon as we receive your clarification, we will deal with your request.
We will respond to you within 20 working days.

 

Request for Review

 

The Council has a Review Panel to deal with complaints from people who are
not happy about the way that it has handled their request. Staff not
involved in the original decision will handle any review.

 

If you want to complain, you can ask the Review Panel to look at the way
that we have dealt with your request. It will consider whether we have
complied with the requirements of FOISA. Please note that if you wish to
complain, you must do so by 25 June 2021.  You must explain why you are
not happy when requesting a review.

 

Please note that the Review Panel cannot look at any decisions taken by
the Council or actions of the Council or any of its employees or a service
provided by it that are not connected to the handling for request for
information.

Dear McGrorry, Jennifer,
Thank you for your email of 26th March and 29th March 2021. I apologize for the delay in responding. Your email, when opened , displayed the original response from your colleague Yvonne Marshall , I wrongly assumed it was confirmation of a delay, especially as the email of 29th March repeated Ms Marshall's original response twice ; I failed to notice that your additional response was at the end of several screens. This is a feature of the software display, I believe, and also on my part for not scrolling to the end.

Not withstanding, I have difficulty in responding to your request to restate my FIR. I do not know how to state my request with greater precision and clarity.

Firstly, Out of Hours is a telephone service and no reference is given by the operator nor by any officer who may attend. Therefor I cannot provide a reference.

Secondly , the incidents I refer to in my FIR, requesting further details, had already been acknowledge in general terms by Community and Enterprise Resources in a letter of 19th March 2021, SLC ref A3562339. I therefor find it difficult to understand the statement in your letter that

"the Council cannot accept your request because it is not
clear what incidents you are referring to. The Out of Hours service
receive many calls on each of the dates you have specified" .

I find it rather curious and odd, that the records of a visit can be provided to one SLC department, yet are not available to another only 7 days later ?

I note in your response that I can raise this matter with Mr. W. Dunn. ; as I do not have his email, and in the interest of the environment and to save paper etc, paerhaps you will forward this email, and the original FIR request, to Mr. Dunn in order that he can review it's contents and make the appropriate response?

Request for review

 

I acknowledge receipt of your email dated 26 April 2021 in which you asked
for a review as you were unhappy with the way that the Council dealt with
your request for information.  The reason why you are unhappy is that the
Council has requested clarification of your requests and you do not
believe that this is necessary.

 

The Council is processing your request for a review.  It will advise you
of the outcome of the review no later than 25 May 2021.

 

Staff not involved in the original decision will handle the review.

 

If you are not happy about the outcome of the review, you can appeal to
the Scottish Information Commissioner.  The Commissioner will decide
whether the Council has dealt with your request properly.

However, without prejudging the outcome of the review, in terms of section
8 of FOISA to make a valid request for information, the requestor must
describe the information wanted in sufficient detail that someone without
any knowledge of the back ground to the request would be able to
understand what subject matter of the information where this is needed to
identify what is being sought. The requestor cannot refer to previous
correspondence or assume that the person processing the request will be
aware of what it is about and able to extrapolate what is being asked. The
request must be able to stand alone and be understood. For instance, if a
requestor was seeking information regarding a planning application, he
cannot assume that referring to a “planning application” without providing
further information such as its reference number or such further
information to enable the Council to identify the relevant application.

 

In the case of your review, the Review Panel will be looking at whether
your reference to “the incident reported to the Out of Hours Service on 30
January 2021” would be sufficient for the Council to identify the
particular incident concerned without having any prior knowledge of the
incident or what reports were received on that day. It may be that the
Council received a number of incident reports and is unable to identify
the particular incident that you are asking about. The Reviewing Officer
will be in contact you in due course.

 

However, if after considering the general advice that I have offered you
believe that you can provide further information regarding the incident,
you should resubmit your request to the Council with that additional
information and let me know whether you wish this review to continue.

I thank you for your response sent to my colleague, Jennifer McGrorry.
Given that the review would be into whether further information was
required to deal withy your request and not the actual processing and
response to it, the basis of the review has been superseded by the further
information that you have provided. In order to afford you your rights
under FOISA to be able to seek a review in relation to the outcome of your
requests e.g. the response provided etc. I will treat this further
information as being a new request for information and have returned it to
Community and Enterprise Resources in order that they respond to you. If
they need anything further, they will contact you direct.

 

Consequently, I will cancel the ongoing review but this does not affect
your rights to ask for a further review for an assessment of compliance
with FOISA if you are unhappy with the way that your requests have been
processed and the response issued. Please note that the Review Panel
cannot consider whether you are unhappy with any operational matters
relating to how your telephone call was dealt with by Community and
Enterprise Resources.
