Thank you for your email of 9^th October requesting information on senior
post holders under the Freedom of Information Act.
I have considered your request for personal information on our employees.
In a Freedom of Information request for personal information, I need to
also consider whether a release would comply with the Data Protection Act
and specifically Principle 1 of that Act. This then needs to be balanced
with the legitimate public interest in the information.
In reaching my conclusion I have focused on:
· The consequences of disclosure;
· The balance between any legitimate public interest in the
disclosure and the rights and freedoms of the employees concerned; and
· Information already in the public domain.
Although there may be a legitimate public interest in knowing the senior
post holders of the College, I do not believe the same exists for their
email addresses and telephone numbers. The College has already published
the names and information about the senior post holders on the College
website. This can be found on the Management and Governance page under
About Us. There is also a page giving contact information for the
College. I believe publication of individual email addresses would breach
our legal obligations of the Data Protection Act. I also believe that the
rights of the individual staff members and our obligations to them under
the Data Protection Act outweighs any public interest in the details of
Having carefully considered our legal obligations under both the Freedom
of Information Act, 2000 and the Data Protection Act,1998, I have
concluded that the information on middle managers and the email and
telephone numbers of all staff are exempt under section 40 (personal
information) of the Freedom of Information Act (FOIA), as the information
constitutes third party data. Section 40(2) provides that personal data
about third parties is exempt information if one of the conditions set out
in section 40(3) is satisfied. Under the FOI Act disclosure of this
information would breach the fair processing principle contained in the
Data Protection Act (DPA), where it would be unfair to that person.
The names of senior post holders have already been published, are in the
public domain and this information is reasonably accessibly to you. It is
therefore exempt under Section 21 of the Freedom of Information Act.
