Dear Department for Work and Pensions,

The 'Advice for decision making guidance' published on GOV.UK says this: 'A2002 DWP is responsible for making decisions on NI credits. Because the method of claiming or applying for them is not the same as it is for benefits, information about them is contained in the relevant operational guides.'

Please send me copies of the 'relevant operational guides' which explain how to claim or apply for National Insurance (NI) credits for limited capability for work if someone is not eligible for either universal credit or 'new-style' employment and support allowance (ESA).

If the correct appraoch is to make a claim for ESA (as is implied here: https://www.gov.uk/national-insurance-cr...), please send me the guidance to staff about the actions that they should take to allow NI credits to be awarded if they refuse a 'new-style' ESA claim due to the NI contribution conditions not being met.
