I am the Information Governance and Compliance manager and it is my responsibility to review requests that my team has responded to.

I can see that in this request you were told that we do not have a reconsideration policy, you are right that we do have this policy and I am sorry for the mistake in our original response.

This policy relates to our handbook:

It states that we are able to reconsider disciplinary outcomes in various situations. It does not relate to decisions not to investigate. If we decide not to investigate a solicitor there is no route of appeal for this. Concerns about the handling of a report can be addressed in line with our complaints process. We are not able to provide the number of times we have reconsidered a decision under this policy as we cannot extract this from our system. To provide a number we would need to review all of our files and this would take longer than the 18 hours we are limited to in our transparency code.

You state there is no Appeal on a decision; this is not what your reconsideration policy states. There are, I think, 5 or maybe 6 reasons it gives as to why you should reconsider and I have sent an email to SARInformationCompliance making it clear why you should reconsider and have beeinn ignored; all I get are generated acknowledgements, which is wholly unacceptable.

Please read your reconsideration policy; it states on what grounds you should reconsider. I tick every one except one of them. To ignore it is to deny the public Justice.

To say to me that there is no Appeal is not the case; your reconsideration policy states that mistakes can be made and in the interests of the public, you should do this; failure to do this is saying your decisions are always right; this goes against your own reconsideration policy.

I believe the SRA does know the information I am asking for but does not want to give this information to me or to the public.

For example, if we rebuked or fined a solicitor, but then found out that we had been misled, we would be able to reconsider that decision in line with our reconsideration policy.

The policy does not relate to complainants who are unhappy that their report has been closed with no further action. This would be handled under our complaints process.

Now about your complaints process...

When I first put my complaint on the Complaint page I never heard another word.

I think you should read or re-read your reconsideration policy... ''If you feel we have dealt with your complaint unfairly...'' and it gives a list.

Dear SRA Information Compliance,

Yes, she came out with no less than 3 different answers.

This is, as you know, wholly unacceptable, it shows me you do not want to answer my question, why should that be, I wonder.. the law states you have to answer and you have skated around it, showing me you don't want to tell me/the public; I think the answer to my question is, NONE, I think you have this so-called reCONsideration policy because it make the SRA look a fair organisation for the public, but it is far from fair, Mr Baraczewski , that's right isn't it.

I have referred this back to the ICO.

It's shameful.
