I am contacting you with regards to you request for an internal review
concerning the delay in a response being provided.
It is clear that in failing to provide you with a response within 40
working days, TfL has breached the requirements of Regulation 5(2) of the
Environmental Information Regulations (EIR) and on behalf of TfL, please
accept our apologies for the shortcomings in the handling of your request.
Regulation 5(2) of the Environmental Information Regulations advises that
‘A public authority holding the requested information has a duty to
communicate that information to the requester as soon as possible and no
later than 20 working days after the date of receipt of the request’. We
will always try to provide a response as quickly as we can and no later
than the 20 working day statutory time period set out by the Regulations.
Additionally an authority can extend the time for compliance by an
additional 20 working days to allow it more time to respond to a complex
or voluminous request.
However we are a large organisation and the FOI Case Management team are
reliant upon the appropriate team to provide the information sought within
a timely manner. Sometimes responses are delayed by staff absence or by
necessary checks to ensure that the response is both complete and
accurate. This means that although over 90% of responses are sent on time,
we are sometimes unable to always respond promptly or, as in the case of
your request, within the extended 40 working day timeframe. Again please
accept my apologies for any inconvenience caused. I believe that a
response was provided to FOI-2460-1819 on 12 March 2019.
If you are dissatisfied with the internal review actions to date you can
refer the matter to the independent authority responsible for enforcing
