Dear Information Compliance,

Section 10(1) of the Freedom of Information Act 2000 states that:
Subject to subsections (2) and (3), a public authority must comply with section 1(1) promptly and in any event not later than the twentieth working day following the date of receipt.

Since the time frame set out in the FoI Act 2000 has been exceeded, and Section 50(1) of the FoI Act 2000 states that:
Any person (in this section referred to as “the complainant”) may apply to the Commissioner for a decision whether, in any specified respect, a request for information made by the complainant to a public authority has been dealt with in accordance with the requirements of Part I.

I am therefore writing to you to remind you of this obligation and give you the further opportunity to complete my request by way of internal review, else I will have to take the failure to adhere to the FoI Act 2000 to the ICO.

Yours sincerely,

Daniel Elliott

Dear Mr Elliott

FREEDOM OF INFORMATION REQUEST REFERENCE NOs:  West Mercia Police 12590
and Warwickshire Police 12591

I write in connection with your requests for information which were
received on 16^th September 2019.  Please find below the responses to your
requests for West Mercia Police and Warwickshire Police information:

Please supply me with officer and staff conviction data broken down as
follows:

The number of staff and officer convictions, for the years of 2008 and
2018 (Jan 1 - Dec 31 of both years) listed by the year of conviction, the
offence and the outcome.

If your records do not go back as far as 2008 then I will accept the
earliest year you have records for after 2008 and 2018 (the years between
are not being requested).

REPLY:

Please be advised that the information that you have requested is not
available in a readily retrievable format. The information regarding
Police officers and staff convictions is not held centrally or in an
electronically retrievable format.

There are in excess of 4260 records for West Mercia Police and 1881
records for Warwickshire Police which would have to be reviewed in order
for us to identify the relevant information for your request. Should it
take approximately 10 minutes per record this would equate to in excess of
1023 hours of work. This is also not taking into account that I would have
to take into account all members of staff/officers that have been employed
by the Force in each year who now no longer work for the organisation.
Therefore the cost of providing you with the information is above the
amount to which we are legally required to respond i.e. the cost of
locating and retrieving the information exceeds the ‘appropriate level’ as
stated in the Freedom of Information (Fees and Appropriate Limit)
Regulations 2004.

In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice for this part of the request and if one part of a
request exceeds the fees limit then S12 of the Act applies to the whole
request

In accordance with Section 16 of the Act I have a duty to provide advice
and assistance in relation to your request, however due to the volume of
records that would need to be reviewed I have been unable to identify
information that could be supplied within the fees limit

Please accept my apology for the late reply.

Every effort has been made to ensure that the information provided is as
accurate as possible.

Your attention is drawn to the below which details your right of
complaint.

Should you have any further enquiries concerning this matter, please write
or telephone the Information Compliance Unit quoting the reference number
above.

Yours sincerely
