Ofcom Enforcement

Dear Derbyshire Constabulary,

Please could you supply the following; from January 2009:

The number of times your police service has been requested by Ofcom to attend site (arranged in advance or otherwise) in order to serve enforcement orders - (seizure of equipment, interview under caution, issuing of a notice, gain entry to premises etc). The number of times for each full year would be useful but not essential as would a breakdown of the service requested of your police force by Ofcom. The ICO has previously declared that Ofcom case numbers to not fall within the category of personal information, so if these can be provided, this too would be helpful.

Secondly, please could you supply the following:

How many times your police service has reported harmful interference to its own communications system(s) to Ofcom. Whether in each of these instances the harmful interference was resolved by Ofcom to the satisfaction of your engineering staff or contractors (i.e. the interference removed completely or mitigated to restore an acceptable level of service). Finally any information you might have as to the cause of the interference (any reports, emails, case numbers etc.)

Thirdly, has your police service raised any formal complaints against Ofcom either internally or to a higher authority? Any documentation would be helpful.

Your request will now be considered in accordance with the Freedom of
Information Act 2000 (the Act). You should expect to receive a response
within the statutory timescale of 20 working days as defined by the Act,
subject to the information not being exempt or containing a reference to a
third party. In some circumstances Derbyshire Constabulary may be unable
to achieve this deadline. If this is likely you will be informed and given
a revised timescale at the earliest opportunity.

 

There may be a fee payable for the retrieval, collation and provision of
the information you request. If this is the case you will be informed and
the 20 working day timescale will be suspended until we receive payment
from you. If you choose not to make payment then your request will remain
unanswered.

 

Some requests may also require either full or partial transference to
another public authority in order to answer your query in the fullest
possible way. Again, you will be informed if this is the case.
