Liquidated Debt

 

In ordinary legal usage the sum will be an ascertained amount.  Most debts
will usually be liquidated – for example an unpaid invoice for a fixed
amount is a liquidated debt.  The sum is said to be liquidated when it
is fixed or ascertained.

 

Unliquidated Debt

 

In the context of a bankruptcy petition, as set out by the requestor, the
Court of Appeal has held that an unliquidated claim/debt is one that
requires the assistance of a judicial process to ascertain the amount due,
therefore the sum is not fixed.

 

Statutory Debt

 

A statutory debt can be defined as an enforceable debt arising by
operation of law.

 

The definitions above have been applied to the sources of income for
Wandsworth Council as follows:

 

• Council Tax and Domestic Rates - liquidated statutory debts.
Generally, the terms liquidated/Statutory debts arise from the words
used in the relevant statute.

• Government Grants – statutory income.
• Interest Receipts - liquidated but could also be statutory depending
upon how the interest became payable.
• Sales – liquidated
• Charges - liquidated, although this depends on what the charges are
for and if they are fixed and where the authority to charge came from,
in which case they could be statutory.
• Council Rents – liquidated and statutory.
• Borrowing and Investments – liquidated
