Dear Shimon Goldwater

Thank you for your email dated 03/05/2018.

Your request is being considered under the terms of the Freedom of
Information Act 2000 (“FOIA”).

Your request has been allocated reference 113-18.

On reviewing your request and regulation 75(3) of the Education (Student
Loans)(Repayment) Regulations 2009, as amended, we have considered it
necessary to seek clarification.  Your request has been interpreted as the
number of student loan borrowers now residing overseas who have had an
assessment on their repayment status.  This would mean that an Overseas
Income Assessment Form has been returned and we have been able to
determine if someone is above/below the repayment threshold and their
repayment status established.  However, your request could also cover
default schedules issued where no form has been returned.  

On receiving clarification of your request we will respond to you under
the terms of the FOIA and within 20 working days.

We will contact you further for clarification of your request if this is
considered necessary.

I refer to your recent email dated 03/05/2018 requesting the following
information under the Freedom of Information Act 2000 (“FOIA”):

“Please can you confirm what number of determinations you have made
pursuant to regulation 75(3) of the Education (Student Loans) (Repayment)
Regulations 2009 (as amended) in each of the years from 2005 to 2018.”

Clarification of your request was sought as your request could cover both
where an Overseas Income Assessment Form had been returned to the Student
Loans Company Limited (“SLC”) and a determination made as to a borrower’s
repayment status, and also where a default repayment schedule had been
issued to a borrower where no form had been returned.

By email dated 15/05/2018 you confirmed the following:

“I am interested only in the number of instances where, as you put it, an

·        the effective date of the data is 01/01/2005 to 29/05/2018;
·        borrowers could be counted more than once if there has been a
requirement to re-assess; and
·        borrowers who have been assessed but do not have repayments
scheduled until a number of months later are included – this would include
borrowers who were assessed before they entered repayment however their
repayment schedule will not start until the following April.  

Internal review process

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review.

Internal review requests should be submitted within two months of the date
of receipt of the response to your original request and should be
