As your email of 24 December 2018 did not constitute a valid request for
information under section 8 of the FOIA, we have calculated the statutory
deadline from your email received on 27 December 2018 when you provided
your full name, which met the requirements of a valid request under the
provisions of section 8 of the FOIA.

Response

I can confirm that the Student Loans Company Limited (“SLC”) holds some of
the information that you have requested. Please note that SLC holds
student finance application and award data for Student Finance England,
Student Finance Wales and Student Finance Northern Ireland. The Student
Awards Agency of Scotland (“SAAS”) would be the relevant public authority
holding any data for students funded through SAAS. In terms of internal
guidance for decision makers, SLC only processes student finance
applications for students applying through Student Finance England (“SFE”)
and Student Finance Wales (“SFW”). Student Finance Northern Ireland
(“SFNI”) applications are assessed by the local Education Authority,
therefore SLC does not hold internal guidance for SFNI applications.

For the information and data that is held by SLC I have reviewed your
request and in consultation with the appropriate departments within SLC, I
have concluded that this information cannot be released as the cost of
complying with your request would exceed the appropriate limit set out in
the Freedom of Information and Data Protection (Appropriate Limit and Fees)
Regulations 2004. The limit applying to SLC is £450 or 2.5 days (calculated
to be 18 hours of staff time at £25 per hour).

The information is therefore exempt under section 12(1) of the FOIA and in
accordance with section 17(1) of the FOIA this letter constitutes a Refusal
Notice in respect of your request.

By way of explanation, the data that you have requested under questions 2,
3, 4, 6 and 7 is not recorded or captured by SLC. The only way to provide
data for these questions would be to review every case manually to search
for and collate the data in question. For questions 3 and 4, SLC does not
require this level of data for the application as it is not relevant to the
relevant regulations on assessment. We review at a specific point in time
whether the applicant is working and that it is not marginal or ancillary
to their studies. We do not hold or require an average weekly pay or hours
worked for each student.

By way of advice and assistance, within the appropriate costs limit we are
able to respond to questions 1 and 5.

Question 1
Please refer to the attached spreadsheet for the requested data. This has
been provided for the current and previous academic years as the current
academic year (2018/19) is not final year data. Please refer to the notes
and caveats associated with the data that can be found on the “results” tab
below the table.

Question 5
Student finance assessors use a combination of the relevant regulations
(currently the Education (Student Support) Regulations 2011 as amended and
the Education (Student Support) (Wales) Regulations 2018 as amended) and
internal documents such as Policy Guidance Chapters when reviewing migrant
worker applications.

The Policy Guidance Chapters are publicly available therefore exempt from
disclosure under section 21(1) of the FOIA on the basis that these are
considered reasonably accessible to you by other means. The Policy
