Wandsworth Request for Information – 2017/15521 – Vehicle infringements on
pavements

 

I refer to your request for information received on 05/09/10/2017.  Please
find our response below.

 

Your request

1.    Please state the for the year 2016 the number of complaints to the
Council about motor vehicles parked, stopped or driven on pavement in the
borough and

2.    also please state the number of times action was taken in
appropriate categories of the type of action taken.

We are unable to provide you with the information you have requested. 
Please see the detailed legal reasoning in Appendix 1 attached.

 

Appendix 1

 

Detailed legal reasoning for refusal

 

Section 12: Exceeds the appropriate limit

 

We consider that it would exceed the appropriate limit, as specified in
the Freedom of Information and Data Protection (Appropriate Limit and
Fees) Regulations 2004; therefore section 12(1) of the Act applies.

 

The appropriate limit has been set at £450 and may include working hours
of any person acting on our behalf at a rate of £25 per hour. This equates
to 18 hours to locate and extract the relevant information.

 

To comply with your request would take in excess of 18 hours. 

 

The enforcement team has confirmed that 4,716 PCNs were issued to vehicles
for parking on a footway in 2016. 

 

In order to establish how many complaints were received would mean a
manual undertaking to trawl through every email received by the team in
2016 that mentions:  “footway”, “footpath”, “pavement”, etc., to identify
and extract information to match them with each PCN. 

 

At a conservative estimation of 5 minutes PCN it would take in excess of
300 hours to identify and extract the relevant information.  There is also
no guarantee that the total number would be accurate because they do not
log phone calls that request enforcement.

 

In accordance with the Freedom of Information Act 2000 this letter acts as
a partial Refusal Notice.

 

You may wish to narrow the scope of your request in order to try and bring
it within the cost limit.

 

You have the right of appeal against the refusal. If you wish to appeal
