Dear Ministry of Defence,
I am making this request under the terms of the Freedom of Information Act 2000.
In a previous disclosure your Ref: FOI2016/09886
"Please provide me with the number of these referrals made by Nottinghamshire ACF since 2010. Please provide your response in tabulated format, showing each year and the number of referrals made by Nottinghamshire ACF in the year."
the MOD confirmed the following:
"It has been confirmed that no Referrals as described in your request were made to the Disclosure and Barring Service between 2010 and the date of your request."
Please provide me with the following information relating to that request,
1.requirements of these referrals - what document specifies the requirements to make referrals and for what , provide some typical examples of when when referrals should be made.
2.What person in the county structure decides if a referral should be made.
3.Who is responsible if a referral that should have been made, is not.
4.Can a person for example, found guilty of assault, continue in the ACF with out a referral being made.
5.In the example above , if that person was allowed to continue to be a member of the ACF who would make that decision and would it be recorded.
6.Would an offence have been committed if there was a deliberate attempt made, to not make a referral on a person where one was required.
7.Would an offence have been committed if there was a deliberate attempt made to avoid a DBS check, where a offence was know to have been committed that would affect its outcome.
Whilst a large number of questions have been asked I believe they will not exceed the time or cost limit as they should be easily answered from current written policy.
