FOI Responses, Hartlepool Council

Dear C Smith,

Further to your request for information, I can advise as follows:-

following consideration of your request, we have determined that the
requested information is exempt from disclosure under s 31(1)(a) of the
Freedom of Information Act 2000.  Under section 31(1)(a) of the Freedom of
Information Act, an exemption applies where disclosure would be likely to
prejudice a range of investigations and conduct, including the prevention
and detection of crime.  We believe that the disclosure of the information
could facilitate fraudulent claims and there is a real and substantial
risk of prejudicing the prevention of crime.   We have taken into account
the recent decision notice published by the Information Commissioner’s
Office on 25^th January 2018 where it was determined that section 31(1)(a)
was engaged regarding the disclosure of credit rate balances.

Taking into account the above issues, the council considers that there is
no over-riding public interest in releasing the information requested. Any
public interest would be best served by upholding the exemption under
Section 31 of the Act as disclosure of the information would be likely to
prejudice the prevention of crime by enabling or encouraging the
commission of offences.

We hope that this information deals with your request, however if you are
dissatisfied with the handling of your request, you have the right to ask
for an internal review. Internal review requests should be submitted to
[1][email address] within two months of the date of
receipt of the response to your original request.

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner for a
decision. The Information Commissioner can be contacted at: Information
Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9
5AF, [2]www.ico.org.uk

FOI Responses, Hartlepool Council

Dear c smith, following an internal review, the Interim Chief Solicitor maintains the application of s.31(1)(a) and considers the arguments previously put forward in respect of this exemption apply. This is furthermore supported by the Information Commissioner's Decision Notice of 25th January 2018, reference number FS50671834.

If you are not content with the outcome of the internal review, you have the right to apply directly to the Information Commissioner for a decision. The Information Commissioner can be contacted at: Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF, www.ico.org.uk
