Response to this request is long overdue. By law, under all circumstances, Tamworth Borough Council should have responded by now (details). You can complain by requesting an internal review.

Dear Tamworth Borough Council,

we seek to receive certain detailed reports under the Freedom of Information Act 2000 (c.36). Could you please reply to me with the following report attached:
- Unclaimed business rate credit balances.
We are cognizant of the fact that Billing Authorities hold on account sums of money that are due to be returned to ratepayers and for a variety of reasons have not been repaid.
I therefore request a breakdown of credit balances accrued since your earliest records, for the amounts owing to all incorporated companies within your authority's billing area, including the following information:
A. The legal name of each business in respect of which non-domestic rate credit balances remain payable
B. The value of overpayment in each case which remains unclaimed
C. The years(s) in which overpayment was made
D. The hereditament address
E. The legal name of each business in respect of which non-domestic rate credit balances have been written back on to the NDR account
F. The value of write back in each case which remains unclaimed
G. The years(s) in which the write back was made (if available)
H. The hereditament address that the write back relates to

Freedom of Information Act 2000 – Refusal of Request under S17

 

This authority has received a similar request recently for information in
your request that we received on 26^th April 2018 regarding business rate
credits.

As you may appreciate repeated requests that are similar in theme posted
to us on a frequent basis not only causes us additional resource in
processing the request that also has an impact on services that we deliver
to our ratepayers.

 

You may have posted this request again in error, but I need to advise you
under S14(2) of the Act we can ignore repeat requests which could also be
considered vexatious and have similar thematic nature where it is
considered the requestor is placing a burden on the authority by the
frequency of requests., please refer to the Act’s extract below.

 

Section 14 Vexatious or repeated requests

(1) Section 1(1) does not oblige a public authority to comply with request
for information if the request is vexatious.

(2) Where a public authority has previously complied with a request for
information which was made by any person, it is not obliged to comply with
a subsequent identical or substantially similar request from that person
unless a reasonable interval has elapsed between compliance with the
previous request and the making of the current request.

 

On this basis I have closed down and refused the request under S17 as it
is considered the request as repeated. I have attached information
relating to Internal Reviews that we are obliged to offer under S45, and
you are suggested that if you wish to appeal this then this is the route
to use before contacting the Information Commissioner direct. This review
will require a full submission on why you feel that this decision to apply
S14(2) exemption to this request is unfair in respect to the public
interest in disclosing the information on a more frequent basis.
