Re: Freedom of Information Act 2000 - Request for Information

I am looking to obtain a report, in excel format, of any business rates accounts, closed or open, in the name of Henkel Limited or in the names of their subsidiary companies, for the period 1 April 2005 to present: -

Acheson Industries
Darex UK Limited
Jeyes Group Limited
Henkel UK Operations Limited
National Adhesives Holding Ltd
Schwarzkopf Limited
Akzo Nobel
Shiseido Group.

The report should include the following: -

1. Account Name
2. Address of the Property
3. BA Reference Number
4. Liability Start Date
5. Liability End Date (if a closed account)
6. If a credit is showing on the account:-
a) Amount of credit
b) Account Number the credit relates to
c) Period the credit relates to
d) Reason for the credit.

Information Request
 
Thank you for your email.  This is to acknowledge receipt of your
request.  Your request will be handled by an officer who will respond
under the terms of the Freedom of Information Act 2000 or Environmental
Information Regulations 2004 as appropriate.

I am writing in respect of your recent enquiry for information held by the
Council, I will respond under the provisions of the Freedom of Information
Act.

 

You asked the following:

I can confirm the Council holds the information you have requested and:

o regarding parts 1 to 5, can confirm it is already publicly available
to you by other means and I am therefore refusing your request under
section 21 of the Freedom of Information Act. The data set is
published bi-monthly, we are unable to extract date of vacancy from
our system and we remove sole trader information as it is personal
data exempt under section 40 (2) of the Act.

o regarding part 6, the Council no longer publishes Business Rates
credits and write ons or Council Tax credits and write ons on our
website or releases this information under Freedom of Information.

 

This is due to an increased risk of fraudulent activity using this data
and your request is refused under Section 31 (1) (a):

 

31 - (1) Information which is not exempt information by virtue of section
30 is exempt information if its disclosure under this Act would, or would
be likely to, prejudice -

(a) the prevention or detection of crime.

 

Section 31 is a qualified exemption, ie even where the exemption applies,
the public interest in disclosure of the requested information must be
considered. The Council considers that there is a strong public interest
in being open and transparent in relation to its functions. However, it
considers that any benefit arising from disclosure is far outweighed by
the real and substantial risk of harm, arising from criminal activities,
which would be likely to follow the disclosure of information relating to
business and council tax credits and write on’s to the world at large.
These include fraudulent attempts to claim the credit amounts from the
Council, by impersonating the business whose account is in credit. The
Council actively seeks to refund any overpayments to businesses in credit.

 

If you are not satisfied with the outcome of your request, you have the
right to ask us to review our handling of your request. Any request for an
Internal Review must be made in writing within 40 days of this response.
