New fencing at Long Valley (B4) training area; reasons, justification and cost

Dear Defence Infrastructure Organisation,

I am writing to you with reference to the recent chain link fencing installed along the eastern boundary of Long Valley (training area B4) along Rushmoor Road between OS Grid Ref: SU 85185 52364 and OS Grid Ref: SU 84949 51798

1. Please can you provide all internal correspondence (email, minutes of meetings, records of decisions etc) relating to the erection of the fence as stated above. I am happy for personal details such as names to be removed however, I am interested in the organisational positions of the individuals concerned, so where these appear in email signatures please can they be retained (I believe this request is inline with ICO guidance).

2. All costs, charges incurred to install the fence as stated above. This cost would be considered a one-off change and therefore not subject to commercial-in-confidence restrictions or redaction.

I am writing to raise my concerns at a lack of response to this FOIA request.

The internal review has been requested over a month ago (15th August) yet remains unacknowledged and no further communications have been received.

This issue is interest to the local community and regards nothing more than the installation of a fence that now restricts public access to military lands that must remain open for recreation when not in use.

Therefore such information is in the public interest and I look forward to your expedient and full disclosure.

Dear Mr Brown,

Acknowledgement of Request for a Freedom of Information Act (FOIA) / Environmental Information Regulations (EIRs) Internal Review

We acknowledge receipt of your email of 14 August. MOD is in the process of conducting an internal review of your request for information under 2020/08514 which was processed under the FOIA. However, it was more appropriate for it to have been considered under the Environmental Information Regulations (EIR). The Department's target for completing internal reviews under the EIR is 40 working days and we therefore aim to complete the review and respond to you by 12 October 2020.

The review will involve a full, independent reconsideration of the handling of the request as well as the final decision.

The response to this request, and the internal review, is now considerably overdue.

A complaint to Information Commissioners Office have written to DIO (their ref IC-65395-R0W6) has been raised and upheld. From their letter I quote:

"There will only occasionally be legitimate reasons why an extension longer than 40 working days is needed."

I therefore look forward to an expedient production of the information requested.
