Dear Mr Bain,

I have received your FOIA requests of which there are 5 in total, of which one is duplicated.

The FOIA allow us to consider if providing the information requested, would exceed the reasonable time and cost limits set out in the act. For the purposes of making this assessment, we will treat the four requests as a single request.

For your information, delay compensation is calculated based on average lateness over a 4 week period and not per the individual time bands listed in your request. We are therefore unable to provide information in the way requested. Can you please confirm if you wish to be advised of the amount paid in aggregate and if so over what period of time?

Please note that the FOIA allows us 20 working days to respond to a request, starting from the date at which the request has been clarified.

Dear Information Rights,
Please provide the compensation paid by Network Rail for delays to SE services since the Government took over the franchise.

I am under the impression that if there is a delay caused by Network Rail, the TOC receive compensation and that is used to pay commuters.

Yours sincerely,

David Bain

Dear Mr Bain,

Please find our response to your request for information about delay
compensation paid by Network Rail since 17th October 2021.

Your request has been handled under the Freedom of Information Act and I
can confirm that we hold the information requested.

For your information (Schedule 8 ) compensation is not calculated in the
way described, but is a periodic bonus or penalty, based on the relative
performance of Southeastern or Network Rail relative to their respective
performance benchmarks. Neither is a penalty paid to Southeastern by
Network Rail intended solely to pay compensation to passengers, but also
to cover other impacts. You can find more information on how performance
payments are calculated and what they are intended to cover on this link

The net Schedule 8 payment made by Southeastern to Network Rail since 17th
October 2021, covering six periods of four weeks is £6.1m per the below.
