Net Nutrient Neutrality Policy

We're waiting for mark to read a recent response and update the status.

Dear West Berkshire Council,

Please treat this as an Environmental Information Request or in so far as any part of it is not properly deemed by the Council as being such it should be considered a Freedom of Information Request.

At some time in March 2022 West Berkshire Council adopted a new planning policy relating to planning applications which may affect phosphates and nitrate outputs in the River Lambourne SAC.

Please can you supply

- Any internal report or emails produced by the Planning team or consultants outlining the development of the new planning policy.

- A copy of the new planning policy adopted by West Berkshire Council and by what process was it adopted and when it was formally adopted.

- Specifically details of the criteria WBC are using to determine if applications are exempt from the requirement for a phosphate and nitrates Habitat Research Assessment (HRA), and when a report is required.

- A copy of any plan or map identifying areas within West Berkshire Councils which are subject to the new planning policy.

- Details of information submitted to applicants confirming that their application may be caught by the new policy.

- A list of all planning applications refused for failure to to provide an HRA before determination.

No internal reports have been produced relating to the development of a new
planning policy.  There are internal emails discussing the advice note from
Natural England however the Council has withheld these under regulation
12(4)(e) of the Environmental Information Regulations 2004 as these constitute
the disclosure of internal communications.  Please see attached annexe which
provides more details.

- A copy of the new planning policy adopted by West Berkshire Council and
by what process was it adopted and when it was formally adopted.

There is no new planning policy adopted by West Berkshire District
Council.

- Specifically details of the criteria WBC are using to determine if
applications are exempt from the requirement for a phosphate and nitrates
Habitat Research Assessment (HRA), and when a report is required.

 

West Berkshire District Council is using the information contained in the
Natural England Water Quality and Nutrient Neutrality Advice note issued
on the 16^th March 2022.  See attached.

- A copy of any plan or map identifying areas within West Berkshire
Councils which are subject to the new planning policy.

- Details of information submitted to applicants confirming that their
application may be caught by the new policy.

On 16th March 2022, Natural England issued guidance to Local Planning
Authorities concerning nutrient neutrality and the role it has to play in
preventing further adverse impacts to protected wetland habitats as a
result of nutrient enrichment. The Local Planning Authority is still
seeking advice from Natural England on how to consider nutrient neutrality
matters affecting planning applications within the River Lambourn Nutrient
Neutrality catchment zone. The site is located within the Nutrient
Neutrality catchment zone for the River Lambourn, the consideration of the
submitted additional information has resulted in the application being
caught by the Natural England advice.

- A list of all planning applications refused for failure to provide an
HRA before determination.

There is no standard response however communications with applicants are
publicly available on the Council’s website and the relevant application
numbers are listed below
