Dear Mr Trice,

Thank you for your information request of 11 July 2016.  Aberdeen City
Council (ACC) has completed the necessary search for the information
requested.

Please supply in csv format, full list of all current Postcodes for
Property Address and Billing Address, Description, Start Date for NDR
properties in The Aberdeen City Council area.

Please see attached spreadsheet detailing the information requested.
Please note that entries relating to individual persons (sole traders)
have been deleted.

ACC is unable to provide you with information relating to individual
persons (sole traders) as it is exempt from disclosure. In order to comply
with its obligations under the terms of Section 16 of the FOISA, ACC
hereby gives notice that we are refusing your request under the terms of
Section 38(1)(b) in conjunction with 38(2)(a)(i) – Personal Information –
of the FOISA.

In making this decision, ACC considered the following points:

ACC is of the opinion that Section 38(1)(b) applies to the information
specified above as the information in question is personal information
relating to living individuals, of which the applicant is not the data
subject.

ACC is of the opinion that Section 38(2)(a)(i) applies, as we consider
that disclosure of this information would be a breach of the first Data
Protection Principle (that personal information must be processed fairly
and lawfully). These individuals have not consented to the disclosure of
their information, and ACC does not consider that they would expect ACC to
release this information about them into the public domain under the
FOISA.

We hope this helps with your request.

Yours sincerely,

Grant Webster

Information Compliance Officer

of the Freedom of Information (Scotland) Act 2002. Please refer to the

Dear Mr Trice,

I refer to your email of 3 August 2016 requesting that Aberdeen City
Council (ACC) review its handling of your request for application of
Section 38(1)(b) in conjunction with 38(2)(a)(i).

A Review Panel met on 23 August 2016.  Please find attached and below the
Review Panel decision.

Please supply in csv format, full list of all current Postcodes for
Property Address and Billing Address, Description, Start Date for NDR
properties in The Aberdeen City Council area.

Please see attached spreadsheet detailing the information requested.
Please note that information relating to individual persons (sole traders)
such as Ratepayer name and billing address, have been removed.

ACC is unable to provide you with Ratepayer name and billing address of
individual persons (sole traders) as it is exempt from disclosure. In
order to comply with its obligations under the terms of Section 16 of the
FOISA, ACC hereby gives notice that we are refusing your request under the
terms of Section 38(1)(b) in conjunction with 38(2)(a)(i) – Personal
Information – of the FOISA.

These individuals have not consented to the disclosure of
their information, and ACC does not consider that they would expect ACC to
release this information about them into the public domain under the
FOISA.

Under the duty to advise and assist criteria of the FOISA, ACC has
provided you with property reference information as a substitute for the
billing address to support your request and to ensure that exempt
information as described in the classes above was not released.

We hope this helps with your request.

Yours sincerely,

Iain Robertson

Review Panel Clerk
