I am writing to request an internal review of University of Abertay Dundee's handling of my FOI request 'NDAs signed by staff leaving the University of Abertay Dundee'.

This is a request for an Internal Review.

The University of Abertay Dundee should realise that the information requested was for the number of employees of the university who signed a NDA as part of leaving employment. This would include those members of staff who were bullied or sexually harrassed out of employment and signed NDAs as part of a severance package to prevent that former employee from disclosing their employment experience. The number would also include the numbers of employees who left employment at the university with certain proprietary knowledge which, for a financial re-imbursement, they signed a NDA in return. The numbers would NOT include current members of staff.

On 17 April 2019 the BBC ran the story "UK Universities Face 'Gagging Order' Criticism" and just three days ago on 5 May 2019 reported "NDAs: UK Universities Misusing 'Gagging Orders" Described as 'Outrage' ". Back on 28 September 2018 The Guardian published the article "Hundreds of Academics at Top Universities Accused of Bullying".

By refusing to answer this FOI request with the accurate numbers of staff who have left the university i.e. by including current staff numbers and COT3 Agreeements (which is information that was not requested) the University of Abertay may be attempting to cover-up a systemic problem by using a cynical tactic of including current staff in the numbers in the numbers of people signing NDAs.

Will the University of Abertay provide the numbers of staff exiting employment having signed an NDA or will the university respond by stating that it is refusing to respond to this request with the information requested?

In response to your message below:

1) In an attempt to reduce duplication of effort, the FOI Processing Officer recycled information from one of the many FOI requests received by the University in recent months relating to the use of NDAs and used the wording of 'current or former employees' because that was what was asked for in the previous response. I can confirm that all of the cases in our initial response to your request relate to staff leaving or who have left the University;
2) None of the cases relate to staff who had been "bullied or sexually harrassed out of employment and [who] signed NDAs as part of a severance package to prevent that former employee from disclosing their employment experience";
3) The University rejects your implication that it may be "attempting to cover-up a systemic problem by using a cynical tactic of including current staff in the numbers in the numbers of people signing NDAs"

This clarification obviates the need to conduct an Internal Review concludes the University response.
