Dear Middle Level Commissioners,

Please treat this request for information as a request under the Freedom of Information Act 2000.

I refer to Section 3 of the Middle Level Act 2018.

Please provide the following information:

1. The date that the Navigation Advisory Committee was established.

2. The names of each of the members of the Committee.

3. The letter, email or other communication to each member of the Committee inviting them to become a member.

4. The Commissioners' statements of their reasons for appointing each person to the Navigation Advisory Committee produced under Section 3(3) of the 2018 Act.

5. Minutes of the meetings of the Navigation Advisory Committee since it was established.

6. Reports produced by the Navigation Advisory Committee under Section 3(7).

7. Responses to Navigation Advisory Committee reports by the Commissioners under sections 3(8) and 3(9).

8. Representations or recommendations made by the Navigation Advisory Committee under Section 3(12).

9. The Commissioners' responses under Section 3(13) to representations or recommendations made by the Navigation Advisory Committee.

Unfortunately in this instance, as the list of information requested is extensive, it will require extra time to collate and respond to this. This is due to government instructions on actions which should be taken to reduce the spread of COVID19, which for us, like many organisations is having a significantly disrupting effect on some areas of our operations. However it is noted that some of this information is already available on our website.

Information disclosed in response to this FOI request is releasable to the public. In keeping with the spirit and effect of the FOI, this letter and the information disclosed to you may be placed on MLC website, together with any related information that will provide a key to its wider context. No information identifying you personally will however be placed on the MLC website if it is placed there.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Middle Level Commissioners's handling of my FOI request 'Navigation Advisory Committee'.

Contrary to your assertion, I have made an extensive search of the Middle Level Commissioners' website https://middlelevel.gov.uk/ and none of the information that I have requested is "already available on your website".

In addition, the Freedom of Information Act 2000 does not permit a public body to refuse to provide information requested on the grounds that

Whilst I understand that the Covid-19 pandemic means that you might take extra time to collate the information that I requested, you are not entitled to simply refuse to provide the information on the grounds of the Covid-19 pandemic.

Please provide the information that I requested regarding the Navigation Advisory Committee within 20 working days.
