We refer below to the the "appathon" event organised by Rewired
State and sponsored by DfE, at which Secretary of State Gove
attended on Sunday afternoon. Details are available here

To be absolutely clear, no question below should be interpreted as
asking for contents of that database.

Please provide copies of the emails (including all attachments) or
meeting minutes which contain the following related to the event:

1) Concerning event organisation, can you please provide:
i) A copy of the event organisation contract/agreement between DfE
and Rewired State
ii) A copy of any and all data agreements and related documents
between DfE and Rewired State or other data controllers.

2) Concerning the National Pupil Database, can you please provide:
i) A copy of the data access and management policies which covers
the version of the data given to Rewired State for the event
ii) Any API (Application Programming Interface to the data)
requirement specifications as stated by DfE, and the dates on which
those (possibly multiple) specifications were given.

iii) Any guidance given by the NPD data controllers (within DfE)
related to parts i, ii
iv) Any guidance given by the NPD data controllers (within DfE)
related to any other similar event

3) Concerning Secretary of State Gove's attendance, can you please
provide:
i) A copy of any briefing note prepared for Secretary of State Gove
about attending the event

4) a copy of any post event summaries or debrief documents from
either DfE staff, or provided to DfE by others.

As some parts of this request may take longer to respond to than
others, please respond as information is complete for each, rather
than delaying all parts due to one.

Dear Sam,
Thank you for your your request for information dated 11th July 2012 about
the National Pupil Database Appathon organised by the Department on 7^th
and 8^th July 2012. I have dealt with your request under the Freedom of
Information Act 2000 (“the Act”).

We have interpreted your request as seeking disclosure of copies of the
emails (including all attachments) or meeting minutes which contain the
following related to the event:

Section 1:

Concerning the event organisation:

i) A copy of the event organisation contract/agreement between DfE and
Rewired State. Please find attached a copy of the contract and the email
to Rewired State that contained this contract. A small section of this
contract has been withheld under Section 35 of the Act and further
information on this exemption is provided below. We have also enclosed
Rewired State’s response.

ii) A copy of the data agreements and related documents between DfE and
Rewired State or other data controllers. Enclosed within the contract are
conditions for processing of personal data relating to delivery of the NPD
Appathon which the contractor agreed to. Additionally I will send you an
enclosure under separate cover which includes a copy of the conditions for
processing of personal data which all developers were required to agree
to. Emails containing these agreements are also enclosed.

Please note that the Department was the data controller for the NPD data
used during the Appathon.  The aim of the event was to give us an insight
into the value of the data to a wide range of people.  We wanted to
understand how developers attending the event would be able to use the
data in different ways and make anonymised data accessible to parents,
teachers and others in user-friendly, visually appealing ways that allow
those unfamiliar with the data to engage with it and explore issues that
matter to them.  We worked closely with Rewired State and the steps taken
to safeguard the data that we made available were appropriate for the
nature and aims of the event. 

Section 2:

Concerning the National Pupil Database you requested:

i) A copy of the data access and management policies which covers the
version of the data given to Rewired State for the event.  Please note
that the NPD data controllers were involved in the organisation of the
event and developed the terms and conditions that covered the data used at
the Appathon.  The data was hosted by the DfE’s hosting provider and
access was provided through an API hosted at the same location.  The
developers attending the event were asked to agree to the specific terms
and conditions provided in section1 [ii] before they were given restricted
access to the data. 

ii) Any API (Application Programming Interface to the data) requirement
specifications as stated by DfE, and the dates on which those (possibly
multiple) specifications were given. Emails relating to this section of
your request are enclosed.

iii) Any guidance given by the NPD data controllers (within DfE) related
to parts i, ii. Please note that this information is provided in response
to your request in section 1 [ii].

iv) Any guidance given by the NPD data controllers (within DfE) related to
any other similar event. This was the first event of this nature that the
Department has run so there is no further information to disclose.

Section 3:

Concerning Secretary of State Gove's attendance, you requested:

i) A copy of any briefing note prepared for Secretary of State Gove about
attending the event. This information is enclosed, however a section
offering suggested speaking notes has been withheld under Section 35 of
the Act. I have provided further information on this exemption below.

Section 4:

You requested a copy of any post event summaries or debrief documents from
either DfE staff, or provided to DfE by others. A summary of the event is
available on the Rewired State website at

this is the only information which falls within part 4 of your request.

Some of the information in the documents enclosed is being withheld
because the following exemption(s) apply to this information:

Section 35 of the Act

The withheld information relates to the formulation or development of
government policy. This is a qualified exemption, and to withhold
information in reliance on this exemption it is necessary to consider
whether or not the public interest in withholding the information
requested outweighs the public interest in disclosing it.  The Department
has considered whether the public interest lies in disclosing or
withholding the information. 

The considerations for disclosure in this instance include the general
public interest in providing greater transparency and accountability for
decision-making processes. There is a public interest in allowing the
public to understand decisions made by public authorities affecting the
lives and work of fellow citizens. There is also a public interest in
accountability and transparency in policy matters which relate to the
spending of public money, and a general public interest in understanding
how government works.

The case for withholding rests principally in the nature of policy making
about sensitive and high profile issues. Ministers and those advising them
need to have the necessary confidence and space to carry out a difficult
task effectively. Public interest and accountability are, under certain
circumstances, more appropriately served without the disclosure of
provisional advice or assumptions because such disclosure is likely to
have a distracting, disruptive or otherwise detrimental effect on the
formulation and development of government policy. In particular,
disclosure in this instance is likely to have an inhibiting effect on the
free and frank provision of advice to Ministers on the National Pupil
Database.

There are live issues associated with the information requested and this
may be subject to further change. Disclosure of this information, whilst
the policy is in the process of formulation, is highly unlikely to be in
the public interest.

It is therefore our considered opinion that the balance of public interest
in retaining some of the information requested outweighs that in
disclosure. 

Section 40 of the Act

Some of the information requested includes details of individuals who are
not in the public domain or are junior officials. The personal data of the
individuals concerned is exempt if its disclosure would contravene the
data protection principles in the Data Protection Act 1998.
