Under the Data Protection Act 2018, Chapter 4, Section 69, paragraph 4 you
are required to provide the contact details of the Data Protection

registered with the Information Commissioner’s Office (ICO) since 19 April

Therefore, I would like the named individuals whom have been acting as the
DPO for Bradford City Council from the 19th of April 2002 until the 1st of
March 2023. These contact details, which the law requires you to publish
under DPA 2018, should include the DPO's full name and duration holding
the post of DPO at Bradford City Council over the specified time period.

 

The Council’s response is set out below:

 

The statutory role of the Data Protection Officer (DPO) came in to force
on 25 May 2018 under the General Data Protection Regulations, when it
became mandatory for certain controllers and processors to designate a DPO
and therefore the Council, as a Public Authority were duly required to
appoint to this position from this date onwards.  The legislation also
requires the Council to publish the contact details of the DPO and provide
these to the ICO.  This is to enable individuals, employees and the ICO to
contact the DPO as needed.

 

Following ICO guidance, the Council is not required to include the name of
the DPO when publishing their contact details but can choose to provide
this if it is necessary or helpful.  Therefore, I can confirm that the
City of Bradford Metropolitan District Councils current Data Protection
Officer, Alison Riley, has been in post since October 2020 to date and her

The following table provides the effective dates/duration of each
individual DPO. However, in relation to your request for previous DPO
‘names’, this information is exempt from disclosure under Section 40(2) of
the Freedom of Information Act 2000.  This provides an absolute exemption
where disclosure of information would lead to a breach of the principles
laid down by the Data Protection Act 2018. I consider the disclosure of
this information would constitute unfair processing in contravention of
the first data protection principle because those individuals whose
personal data has been withheld would not have had any reasonable
expectation that their names would be disclosed in these specific
circumstances.  Therefore, in accordance with Section 17(1) of the Freedom
of Information Act, this response acts as a refusal notice for this
element of your request under the provisions of Section 40(2) of the Act.

review of the decision made under the Freedom of Information (FOI) Act
2000.  I have considered the information presented to me and have reviewed
the initial response issued.

 

I am satisfied that the initial reply was provided in compliance with
Section 40(2) of the Freedom of Information Act in relation to your
request for the names of the previous Data Protection Officers, as this
information constitutes personal data under the provisions of Section
40(2)(a) of the FOI Act.  I consider the disclosure of the previous Data
Protection Officers names would constitute unfair processing in
contravention of the first data protection principle under the provisions
of Section 40(3A)(a) of the FOI Act, as those individuals whose personal
data has been withheld would not have had any reasonable expectation that
it would be disclosed in these specific circumstances when no longer in
post.

 

The name and contact details for the current Data Protection Officer was
provided to you within the initial response, which I have re-attached for
you.  Links to the relevant Council web pages where the DPO contact
details are published were also provided, along with the effective
duration period of previous Data Protection Officers.  The Council are
compliant with its legislative obligations.

If you are requesting CCTV footage:

 

If your request is in relation to a road traffic collision or incident (without Police involvement) we are unable to accept
Subject Access Requests in these instances, as we would only be able to provide still images of you, we cannot release footage
of other individuals, third parties or images that would lead to the identification of others, as this would be classed as their
personal data and not suitable for release under the Data Protection Act 2018. 

 

In these instances you should contact your Insurance Company or Solicitor to request the footage under Schedule 2, Part 1(5) of
the Data Protection Act 2018. Please note, the Council will levy a charge for this.  The online CCTV form can be located per the

If you have been involved in a car collision or incident with Police involvement, and you have a crime reference number, you
should contact the Police directly to request CCTV footage and not the Council as you will be advised to re-contact the Police.

Dear ICO - Paula Flanagan,

I write to lodge a new complaint to yourself as the Information Commissioner's Office (ICO) regarding the City of Bradford Metropolitan District Council's (CBMDC) handling of my FOI request via the WhatDoTheyKnow website. See the following :

Given the attached document which is freely available on the internet clearly names the previous Data Protection Officer as being Dany Mistry, and also the fact that her name is plastered all over the WhatDoTheyKnow (WDTK) website.
