Dear Medical Practitioners Tribunal Service,

Separate to my previous FOIA request of the GMC as FtP complainants to themselves, in particular given intrinsic immunity for vexatious complaints. In preparation of original defence of non-medical complaints, I make this FOIA request in relation to the MPTS both as an organisation/directorate and of its members as FtP complainants. For a FTP defence, can I request the following information under the Freedom of Information Act:

1. Given a duty to declare conflict of interest. How many current MPTS tribunal members have been complainants to the GMC FTP directorate ever, and are currently live. Please also give this as a percentage.
2. What percentage of direct and indirect MPTS complaints have been accepted by the GMC this year 2022 and last year 2021.
3. How many FTP complaints has the GMC received from MPTS members this year and last year.
4. How many of the current MPTS tribunal (medical component is only a third of a panel) have had GMC FTP action taken against them at any point in their lifetime. Please also give this as a percentage.

Yours faithfully,

Dr Ali

Dear Medical Practitioners Tribunal Service,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Medical Practitioners Tribunal Service's handling of my FOI request 'MPTS as GMC complainants'. The request has been made early in anticipation of vexatious actions by your organisation.

This is my third request in a year and it is also in direct relation to another FTP complaint by one of your tribunal members which will also make any subsequent tribunal unfair. I have a right to a fair trial/tribunal despite your attempts to prevent this, thus like with current case the High Court will be involved and thus it is clear to all; information about MPTS complaints to the GMC is needed. The request has been kept simple and is clearly not vexatious.

May I remind you that the FOI Act requires an 'applicant blind' approach, which is to say that it embodies the principle that information is available to anyone and requests must be assessed without consideration of who made them. Contrary to the ICO's guidance (see https://ico.org.uk/media/for-organisatio...), your decision has been influenced by your knowledge or view of me as the requester, rather than an assessment of the request in isolation.
For that reason I am asking you to review your response and, if the exemption is upheld, to provide an assessment which does not take your knowledge of the requester into consideration.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/m...

Yours sincerely,

Dr Ali

Dear MPTS FOI Ms Adams and Mr Graves,

Thank you for the email update 6th April. I would remind you that time is important and I continue to need the information. I am disappointed information has not been provided.

With already multiple ICO complaints it appears not enough to make you stop being awkward. To force your hand into actually doing FOIA work and providing the information required. Further to the GMC Legal department contacting Mr Graves to stop some of his bad practices. I highlight in advance, I will be demanding MPTS case directions from your superiors for information provision, in anticipation of continuation of your history of bad practices and slowness of the GMC Information Directorate. I will not make a new request (reset the clock and misuse like other emails) or use another platform as information provided should be freely available and used by all doctors regardless of gender, colour, race, creed or other discriminator.

Yours sincerely,

Dr Ali
