Dear Thames Water,

Request made under The Environmental Information Regulations 2004.

Where Thames Water accepts waste-water containing radioactive particulates or radiation-bearing liquid(s) from its customers or if radioactive waste is detected within the public sewer infrastructure system (where such waste may have been unlawfully deposited into the sewerage system); please supply the written management policy for handling/ storing / disposing of such radioactive sewerage or substance.

In January 2016 (the 31st), I requested that information be disclosed under the Environmental Information Regulations. The Regulations allow 40 calendar days in which to respond to such a request.

You have failed so far to respond to my valid request; You have a maximum of 4 days left before you are in contravention of the law. Please respond now to avoid a complaint to The Information Commissioner.

COMPLAINT

This is a formal complaint that despite 40 days ago upon my I request under the Environmental Information Regulation 2004, (i) you failed to acknowledge my request; (ii) you failed (Contrary to the Regulations) to respond to my request; and (iii) you failed to proactively make available the information (causing my need to make a statutory request).

This complaint is the first step in proceedings to The Information Commissioner.

Please: (a) Reply to my Complaint in full within 7 calendar days and (b) disclose the requested environmental information within 7 calendar days. If the requested information has not been disclosed before the time-limit, I will submit an official complaint about your unlawful acts to The Information Commissioner's Office.

Dear Thames Water,

I am very disappointed at your entirely non-existent customer care; I am even more disappointed at your total disregard for the law. I am concerned that Thames Water has something to hide concerning the level(s) and monitoring of level(s) of Radioactive Waste within the Public Sewers.
I will sending a formal complaint to Thames Water in the coming days. I will be Notifying the relevant Regulators of my concerns and I will be Complaining to The Information Commissioners Office to investigate your breaches of The Environmental Information Regulations.

1. Background

I refer to your request for information under the Environmental Information Regulations 2004 ("the Regulations"). My sincere apologies for the delay in responding. Your request read as follows:

"Where Thames Water accepts waste-water containing radioactive particulates or radiation-bearing liquid(s) from its customers or if radioactive waste is detected within the public sewer infrastructure system (where such waste may have been unlawfully deposited into the sewerage system); please supply the written management policy for handling/ storing / disposing of such radioactive sewerage or substance."

2. Thames Water's response

We do not have an internal written management policy for handling/ storing / disposing of radioactive sewerage or substances but are bound by and comply with the rules set out by the Environmental Agency. Radioactive waste is controlled at source and organisations that have a radioactive source are required to obtain a permit from the Environmental Agency. We do not hold source radioactive material and therefore are not required to have this type of permit.
