Mobile Wagons Gas Safety Outdoor Events / Indoor Events

Dear Belfast City Council,

The information I have requested is environmental information, as defined in Regulation 2(1) of the Environmental Information Regulations, it is exempt from disclosure under Section 39 of the Freedom of Information Act 2000. However, I want our Council to consider my request under regulation Section 74 of the Freedom of Information Act to consider my request under the Environmental Information Regulations 2004, which gives me the public qualified rights to access to environmental information held by a public authority. I wish our Council therefore to considered my request under the Environmental Information Regulations.

With the recent outdoor events in the parks and fields around Belfast such as Ben Nikki and other community events in the council area from the 24th June 2018 till 24th June 2019 regards to gas safety.

1. How many of the mobile gas catering wagons were checked by council staff for gas safety certification to ensure public safety at these events in or on council fields or establishments to ensure public safety is prioritised at these events?

2.How many of the mobile gas catering wagons were inspected by council representatives for gas safety on the premisses of the event be it a park or field?

3. How many mobile gas catering wagons were refused access into the events by council staff as they were not compliant with current regulations?

4. How many events from the dates above have Belfast City Council specifically inspected gas catering wagons for gas compliance as it has been reported that BCC are "Rolling Out" the commercial safety message?

5. How many mobile gas catering wagons were there, at each event from the dates above please list and subsequent findings/action by council staff.

Thank you for your email dated 24 June 2019 requesting, under the
Environmental Information Regulations 2004, information on gas safety of
mobile wagons at outdoor and indoor events. 

 

I can confirm that Belfast City Council only holds some of the information
you have requested.  Where the information is not held by the Council this
is clearly indicated in the response below.  The Council has decided that
the information it does hold can be disclosed into the public domain. 
Accordingly, this information is provided below.  For ease of reference, I
have reproduced each part of your request and provided the Council’s
response directly below each part.

 

With the recent outdoor events in the parks and fields around Belfast such
as Ben Nikki and other community events in the council area from the 24th
June 2018 till 24th June 2019 regards to gas safety.

 

1.     How many of the mobile gas catering wagons were checked by council
staff for gas safety certification to ensure public safety at these events
in or on council fields or establishments to ensure public safety is
prioritised at these events?

 

At the Belsonic event on 12 June 2019, a Council licensing officer along
with the event promoter’s health and safety officer requested gas safety
certification from three food vendors who were using gas.  The Council
holds no further information pertaining to this part of your request.

 

As advised in our response of 31 August 2018, to a previous information
request you made to the Council on this subject, the Health and Safety at
Work (NI) Order places the responsibility on the employer to ensure the
safety of employees and person affected by his undertaking.  Therefore,
the obligation for ensuring gas safety of gas catering at events will rest
with the promoter/event organiser or employer in control of the premises.
Only gas installers on the Gas Safe Register (GSR) with necessary
commercial and mobile catering competencies may carry out work on gas
systems within such premises.

 

I would also advise you that vendors operating on the site are informed of
the requirement for gas safety certification prior to moving onto an event
site and Council entertainment licensing officers are involved advising
and checking on various safety requirements and may request gas safety
certification from vendors.

 

2.   How many of the mobile gas catering wagons were inspected by council
representatives for gas safety on the premisses of the event be it a park
or field?

3. How many mobile gas catering wagons were refused access into the events
by council staff as they were not compliant with current regulations?

 

The Council does not hold information pertaining to this part of your
request.

The Council does not hold any information pertaining to this part of your

SK9 5AF.  However, I would advise you that the Information Commissioner
has indicated that a review will not be undertaken unless the Council has
first had an opportunity to re-consider its decision.
