I refer to your recent email dated 11/06/2018 requesting the following
information under the Freedom of Information Act 2000 (“FOIA”):

“Please can you confirm any rules which the SLC applies when making
determinations pursuant to regulation 75(3) of the Education (Student
Loans) (Repayment) Regulations 2009 (as amended). Please also send me
copies, if they exist, of any documents recording decision-making policies
in respect of that regulation.”
Response

Having conducted a search of our records I can confirm that the Student
Loans Company Limited (“SLC”) holds some information that falls within the
scope of your request.

With regards to the amount to be repaid by overseas borrowers, I would
refer you to the 2017/18 Repayment Guidance Chapter which is publicly
available (therefore exempt from disclosure under section 21(1) of the
FOIA), and can be found at:

While regulation 75(3) is not specifically referred to in the Repayment
Guidance Chapter, the 'Overseas Borrowers - Plan 1 Loans' (page 12) and
'Overseas Borrowers - Plan 2 Loans' (page 14) sections under the Repayment
Threshold chapter explain how amounts are calculated and provide useful
examples. Annex B (Plan 1 loans) and Annex D (Plan 2 loans) provide band,
price level index and monthly instalment figures.

I am writing to request an internal review of Student Loans Company Limited's handling of my FOI request 'Method of making determinations under regulation 75(3) of the 2009 Regulations'.

I wish to understand how the SLC makes determinations as to the expected likely income of overseas borrowers over the 12 months following the determination date. For example, the SLC asks borrowers to submit 3 months of recent payslips. Does the SLC always simply assume that during the next 12 months the borrower's income will reflect exactly the sums in the payslips, or is the determination more sophisticated that that. The SLC's answers so far have pointed me towards publicly available information regarding the relevant law, of which I was already aware. The SLC has not provided any documents or information setting out the rules which it applies in its internal decision-making process when determining likely prospective income of overseas borrowers.
