I am writing to request the degree classification by nationality of
students who have graduated from MEng Chemical Engineering for academic
year 2014/15, 2015/16 and 2016/17.

 

For each of the said graduation years, please prepare a spreadsheet
detailing the number of students awarded first class honors (1),

The University has now considered your request and some data which we hope
is of use is shown below. Please note that we have represented the data in
this way, i.e. a table of the degree classifications for the course in the
years requested and a table of the nationalities of the students on the
course in the years requested, as we deem that to provide the data
overlaid together as requested would lead to students and their degree
classifications becoming identifiable due to the low numbers of many of
the nationalities on the course. It is the combination of these two
together, rather than the individual components separately, that leads us
to feel that the exemption at Section 40 (2) of the Freedom of Information
Act 2000 - third party personal data – is engaged and the representation
in this way is therefore deemed exempt from disclosure.

 

Section 40(2) of the FOIA provides an exemption where the application for
personal data is made by someone other than the data subject.  To apply
the exemption appropriately, the conditions set out in Section 40 (3) of
the FOIA should be satisfied. Section 40 (3) of FOIA states that where
disclosure of the information would contravene any one of the eight
principles in the DPA then this data is exempt.

 

Any disclosure under the Freedom of Information Act 2000 is considered a
disclosure “to the world”. The University of Manchester does not believe
that the release of the data requested will be fair or lawful under the
terms of FOIA as the students on this course would have no expectation
that their personal data, i.e. their nationality coupled with their degree
classification, would be released “to the world” for this purpose. As
such, disclosure of the information requested by you under Section 1(1) of
the FOIA would be unfair and thus in breach of Principle 1 of the DPA and
hence Section 40 (2) of the FOIA applies. This email serves to act as a
refusal notice for that representation of the data, in accordance with
Section 17 (1) of the Freedom of Information Act 2000.
