Dear Avon and Somerset Constabulary,

The Avon and Somerset Constabulary has had an ongoing process regarding the review of Injury On Duty awards.

Can you please provide details of meetings that have been held in the past 12 months regarding this subject.

I am particularly interested in the meetings attended by the following people,
Andy Marsh (Chief Constable)
Julian Kern (Chief Finance Officer and Director of Human Resources)
Dr Bulpitt (Force Medical Adviser)
Catherine Dodsworth (Head of HR)

I am not asking for meetings where all these persons were present at any particular time, but meetings where any of these persons (or their nominees) attended, both internally and externally.

I am aware for example that one such meeting took place between Andy Marsh and Dr Bulpitt on 28/06/2016 (am) @ Portisfields.

I would like times and dates of the meeting, persons present, copies of agendas, minutes of the meetings and any documents produced or referred to.

·         30^th March 2016– IOD Liaison Group Meeting – Information has
already been provided to you under FOI reference 1235/16.

·         14^th June 2015 – IOD Liaison Group Meeting – Information has
already been provided to you under FOI reference 1235/16.

·         12^th September 2016 – Review of outstanding cases – CD, HC, SC,
DJ, SH, JK, CJ – no papers produced update as to where the organisation
was in relation to specific cases/individuals.

You will note that redactions have been made in respect of both minutes.

With regards to the minutes dated 1^st March 2016, the information
redacted constitutes personal information. The exemption applicable to
this is Section 40(2), third party personal information. This is an
Absolute exemption so therefore there is no requirement to conduct a harm
or public interest test. Any information is exempt from disclosure under
the Freedom of Information Act if it relates to or is supplied by another
individual and disclosure of that information would contravene any of the
principles of the 1998 Data Protection Act, in this particular case,
disclosure of this information would contravene Principles 1 and 2 of the
Act, whereby personal data shall be processed fairly and lawfully and only
obtained for one or more specified purpose or purposes.

With regard to the minutes dated 23^rd October some of the information has
been redacted where the information constitutes legal advice and as such
is exempt under section 42, legal professional privilege and where some
information relates to a current investigation and is exempt under Section
30, investigations and proceedings conducted by Public Authorities. 

 

Section 42 is a qualified and class based exemption which means that there
is no requirement to identify and evidence the harm that would be caused
by disclosure, however there is a requirement to consider the public
interest.

Public interest test

Factors favouring disclosure

Disclosure would demonstrate the Constabulary is transparent and
accountable.

Factors favouring non-disclosure

The information contained within the minutes detail legal advice  to the
constabulary from our in-house lawyer.  The principle of  client-legal
professional privilege is long established. Disclosure of this may lead to
a breakdown in trust between lawyer and client to the detriment of the
Constabulary.

Balance test

After weighing up the competing interests, I have determined that the
disclosure of the above information would not be in the public interest. I
believe the importance of the factors favouring non-disclosure outweigh
those considerations favouring disclosure.  At this time the potential
harm outweighs any public benefit. There is no further tangible community
benefit in complying with section 1(1)(b) of the Act at this time.  In
accordance with the Act, this letter represents a Refusal Notice for this
particular request.

Section 30 is a qualified and class based exemption which means that there
is no requirement to identify and evidence the harm that would be caused
by disclosure, however there is a requirement to consider the public
interest which follows below.

Public Interest Considerations

Factors favouring disclosure

Disclosure of the requested information may go some way to promote trust
in the police service demonstrating that the Constabulary robustly
investigates offences of this nature.

Factors favouring non-disclosure

It is the Association of Chief Police Officers’ approach that information
relating to an investigation will rarely be disclosed under the provisions
of the Freedom of Information Act.  As the investigation is ongoing
disclosure of the details you have sought at this stage would prejudice
and compromise the investigation. The right to a fair trial would also be
undermined.

Suspects could then employ measures to evade apprehension.  This would
result in potential damage to the service and the wider community as this
would hinder the prevention or detection of crime, as such negatively
affecting our ability to enforce the law.

Balancing test

After weighing up the competing interests, I have determined that the
disclosure of the above information would not be in the public interest. I
believe the importance of the factors favouring non-disclosure outweigh
those considerations favouring disclosure.  At this time the potential
harm outweighs any public benefit. There is no further tangible community
benefit in complying with section 1(1)(b) of the Act at this time.  In
accordance with the Act, this letter represents a Refusal Notice for this
