Dear infocompliance, Resource,

Dear Ms Kidd,

Thank you for your emails dated 28^th August 2018 and 5^th September 2018
requesting information about the University of Warwick. Your request is
being considered under the Freedom of Information Act 2000. Please find
below your request and our response.

I would like to know the following information

1.      Total MBA Budget per year, per course e.g. full
time/part-time/flexible/executive.

a)     If possible how much of this is spent on teaching, overseas trips
and scholarships.

The University is withholding the requested information since we consider
that the exemption under section 43(2) of the Freedom of Information Act
2000 applies. Section 43(2) states that “information is exempt information
if its disclosure under this Act would, or would be likely to, prejudice
the commercial interests of any person (including the public authority
holding it)”.  We consider that the release of the requested information
would be likely to prejudice the commercial interests of the University.

Warwick Business School (WBS) is the largest surplus generating department
of the University of Warwick, delivering market leading programmes for the
Undergraduate and Postgraduate market. The information requested with
respect to the School’s MBA programmes, which are a particularly
competitive market, is therefore deemed to be commercially sensitive
information, as it would directly impact student recruitment activity,
which is the core income generating activity of the School. To this
extent, disclosure of such information would be detrimental to WBS as it
directly relates to the School’s commercial operations.

WBS operates in the Business School market, which is a highly competitive
segment of the HE Sector.  The MBA market is particularly competitive. To
share information of the nature requested with regard to the School’s MBA
programmes would enable the School’s key competitors to have access to
highly sensitive data and result in a competitive advantage. Disclosure of
key metrics about the MBA programme would have a significant negative
impact on the School’s student recruitment which would significantly
negatively impact the School’s financial performance and so would be
detrimental to business confidence in this key University department.

The University considers that the likelihood of prejudice to be caused is
high to the extent that competitor business schools have access to
information with regard to the School’s MBA programmes, this would enable
competitors to have a more informed understanding of the School’s overall
strategy with respect to the programme. Given the highly competitive UK
and Global Business School market, this would enable a significant
competitive advantage which would detrimental to the future success of
WBS.

The exemption at section 43(2) is a qualified exemption which means that
the University must consider whether the public interest in maintaining
the exemption outweighs the public interest in disclosure. The University
considers there is no overriding public interest in the circumstances that
would warrant prejudicing the University’s commercial interests. It is
important to note that disclosure under the Freedom of Information Act is
effectively disclosure to the general public, not solely the person who
has made the request. Therefore, the University is of the opinion that the
public interest lies in favour of withholding the requested information.

2.      The number of non-academic staff that support the above courses
e.g. recruitment staff/administration staff/ operational staff. Can this
information be provided with if they are full time, part time etc, and the
type of contact and job title
