Summary of Response
A copy of the information is attached with redactions. Information that
has been withheld is explained below.
NHSBSA and Department of Health and Social Care (DHSC) communicate on a
regular basis regarding the England Infected Bloods Support Scheme, the
purpose of those communications are for NHSBSA to provide information to
DHSC, so DHSC can make informed decisions.
Section 40(2) – Personal Data
Please be aware that I have decided not to release details of all
staff/beneficiaries as this information falls under the exemption in
section 40 subsections 2 and 3 (a) of the Freedom of Information Act.
This is because it would breach the first data protection principle as:
a) It is not fair to disclose these people’s personal details to the
world and is likely to cause damage or distress to staff/beneficiaries
b) These details are not of sufficient interest to the public to warrant
an intrusion into the privacy of those staff/beneficiaries.
As well as names, e-mail addresses, job titles and phone numbers, any
reference by staff to their personal lives or references to
beneficiaries/their payments have also been redacted.
Annex A in the attached letter sets out the exemption in full.
Section 31 – Crime Prevention
Specific information is being withheld as they fall under the exemption in
31(1) (a) of the Freedom of Information Act. In applying this exemption we
have had to balance the public interest in withholding the information
against the public interest in disclosing the information. Annex B in the
attached letter sets out the exemption in full., as well as the factors
the Authority considered when deciding that in all the circumstances of
the case, the public interest in maintaining the exemption outweighs the
public interest in disclosing the information. Information redacted under
this section is labeled “Section 31” within the document.
