Information Commissioner's Office

21 September 2018

Case Reference Number IRQ0779580

Dear Mr Paulley

Information request

I write in response to your email of 23 August 2018 in which you submitted
a request for information to the Information Commissioner’s Office (ICO).
Your request has been dealt with in accordance with the Freedom of
Information Act 2000 (FOIA).

Your request

“Please provide me with the information you redacted from this FOI release
[1]https://www.whatdotheyknow.com/request/5... as a result of being "not
in scope" or "as it is does not fall in the scope of
(the) request”.”

We understand your request relates to the information that was withheld as
out of scope in connection with the request we dealt with under the
reference IRQ0768784.

Our response

I can confirm we hold information that falls in the scope of your request.

Please find attached the information we disclosed in response to
IRQ0768784, which now includes the information previously redacted as out
of scope of that request.

Some names and contact details within the correspondence remain redacted
in line with section 40(2) of the FOIA.

Section 40(2) exempts information in response to a request if it is
personal data belonging to an individual other than yourself and it
satisfies one of the conditions listed in the legislation. The condition
contained in section 40(3A)(a) applies - that disclosure would breach one
of the data protection principles. The principle is that -

“Personal data shall be processed lawfully, fairly and in a transparent
manner...”

We do not consider that disclosing this information to you, and
consequently the public, is necessary or justified in order to satisfy
your information request and the requirements of the FOIA. In the
circumstances of this request there is no strong legitimate interest that
would override the prejudice to the rights and freedoms of the data
subject/s.

This concludes our response to your request.

Review Procedure

If you are not satisfied that your request for information has been dealt
with correctly, please write to the Information Access Team at the address
below, reply directly to this email (with the reference number contained
within the square brackets left intact), or email us at

IRQ0779580.

Your request for a review should be submitted to us within 40 working days
of receipt by you of this response.  Any such request received after this

Ultimately if you are not satisfied that your request for information has
been dealt with correctly you have a further right of appeal to this
office in our capacity as the statutory complaint handler under the
relevant legislation.  To make such an application, please write to our
Customer Contact Team at the address below, or visit the ‘Report a
