Thank you for your information request received on 30 March 2018 where you
asked:

 

Please could you provide detail on how many market stalls were paid for on
the Market in Boston for every market day for the last five years.

Please could you provide the number of market stalls paid for at Boston
market every market day in the years 1983 – 1987?

 

Under Section 1(1)(a) of the Freedom of Information Act 2000 we can
confirm that Boston Borough Council does hold some of the information
specified in your request.  However to  supply you with details on how
many market stalls were paid for on the Market in Boston for every market
day for the last five years,  would entail going through paper records
manually for the last five years and manually counting the information.
 We have estimated that this would take in excess of 18 hours to manually
produce the list you require.

 

I am therefore unable to comply with this aspect of your request as the
information is exempt under Section 12 of the Freedom of Information Act
which allows a public authority to refuse a request if the cost of
providing the information to the applicant would exceed the ‘appropriate
limit’ as defined by the Freedom of Information and Data Protection
(Appropriate Limit and Fees) Regulations 2004:

 

“12 Exemption where cost of compliance exceeds appropriate limit

(1) Section 1(1) does not oblige a public authority to comply with a
request for information if the authority estimates that the cost of
complying with the request would exceed the appropriate limit”.

 

The Regulations provide that the appropriate limit to be applied to
requests received by local authorities is £450 (equivalent to 2.5 days of
work, estimated at a rate of £25 per hour).  In estimating the cost of
complying with a request for information, an authority can only take into
account any reasonable costs incurred in:

 

“(a) determining whether it holds the information,
(b) locating the information, or a document which may contain the
information,
(c) retrieving the information, or a document which may contain the
information, and
(d) extracting the information from a document containing it”.

 

In terms of your second question  we do not hold the paper records for the
number of market stalls paid for at Boston market every market day in the
years 1983 – 1987 and so are unable to provide you with the information.

 

However in order to offer advice and assistance in accordance with section
16 of the FOIA, we have provided you with the total Market Rental income
for the last 5  financial years as follows:

2013-14 £201,238

2014-15 £198,581

2015-16 £185,969

2016-17 £172,417

2017-18 £167,035

Is it possible to further request the prices the Council has charged per pitch in the years you've listed the income above?

This could then give me some kind of average how many stalls there has been in the time I've asked about.
