Under FOI legislation I would like to know which individuals in the apparatus of government in Northern Ireland have senior decision-making authority - from medical, scientific, financial, legal, educational and political perspectives - over policy and strategy development and the management of the existing Covid19 vaccine programme in Northern Ireland.

While you have submitted a valid FOI request as set out in Section 8 of the Freedom of Information Act (FOIA) there is provision within the FOIA Section 45 Code of Practice for Public Authorities to deal with requests outside the FOIA as normal course of business.

However, in line with section 16 of FOIA – duty to provide advice and assistance, please be advised that the Executive Office (TEO) is only one of a number of separate and legally distinct public authorities within the Northern Ireland Executive.

Within the NI Executive, the Department of Health (DoH) has responsibility for Health and Social Care, Public Health and Public safety. It takes the lead in responding to the Covid 19 health pandemic and therefore may hold information pertaining to your request. Dear Mr Methven

 

To clarify TEO does not hold recorded information on the names of
individuals over the policy and strategy development and the management of
the existing Covid19 vaccine programme in Northern Ireland.

 

Under FOIA a public authority is only obliged to consider disclosing the
recorded information it holds and is not required to find or obtain
information held by another public authority or to create new information
in order to respond to a request.

 

In regard to Section 16 of FOIA - duty to provide advice and assistance
the Department considers that it has fulfilled its obligations and
provided you with advice on where information may be available i.e. The
Department of Health (DoH) which have taken the lead on the Covid 19
pandemic Health response including the vaccine programme.

Dear Executive Office (Northern Ireland),

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Executive Office (Northern Ireland)'s handling of my FOI request 'Management of Covid19 vaccine programme'.

On NIdirect website it states: ‘The Northern Ireland Executive Committee runs the devolved government in Northern Ireland.’(https://www.nidirect.gov.uk/articles/nor...). How can you ‘run’ a devolved government and not have a record of who takes major decisions - in this case about a mass vaccination programme?

Your FOI response states that the Executive does not hold information on who has policy making authority for the implementation of the Covid19 vaccine rollout and refuses to say who holds this information. This information should be easily accessible by the public in order to aid in the accountability of both elected representatives and officials.

Your latest response in declining to release such information is contrary to the principles of open and transparent government and therefore contrary to both the spirit and the letter of the FOI regulations. Please review your latest decision.
