Freedom of Information, Daventry District Council

Dear Mr Mendelson,

Thank you for your email.

The Council has given your request careful consideration, but regret to inform you that your request seems to have no public purpose. It would appear to be a commercial request which does not meet the transparency objectives of the Freedom of Information Act (FOI). It is unclear from your request in its current form what, if any, public interest there is in disclosing this information.

Without clear public interest the Council considers commercial requests vexatious in line with the Upper Tribunal ruling recently upheld by the Court of Appeal: http://www.bailii.org/uk/cases/UKUT/AAC/...

In this judgement Judge Wikeley indicates in paragraphs 35 and 38 that improper use of FOI [such as no public interest] is a valid consideration to make when considering if a request is vexatious. Using the Freedom of Information Act to gain a commercial advantage or seek opportunity over another can be included within this definition. It would be considered an abuse of a statutory process that is designed to promote open accountable local government, not provide commercial organisations with leads into organisations to promote or sell goods or services.

Of course a public body is not always aware of some wider public interests in a particular area and would like to seek clarification to be able to fully assess any possible public interest before proceeding.

The Council does publish expenditure data, budget information as well as contract information on our website. It is important that the public know how the Council spends public money. Please see the Council’s transparency pages here: https://www.daventrydc.gov.uk/your-counc... and contract information is available here: https://www.daventrydc.gov.uk/business/p...

If you are unhappy with the way your request has been handled, you may ask for a review. Please write to:
