M11 incident loughton area 9th August 2020

Dear Essex Police, Fire and Crime Commissioner,

On 9th August M11/Loughton area there was an accident around afternoon between 13:00 and 16:00 there was a long stretch of traffic.

Please kindly provide me

1. the time of the incident reported.

2. time the X mark( no entry) digital message was displayed at the motorway entrance to M11 northbound.

3. CCTV of vehicles using hard shoulder and crossing verge hatching a to access slip road.

4. Number of vehicles using the hard shoulder

5. Number if notice of intended prosecution letters sent related to contraventions of sec 3 of the road traffic act 1988

6. Number of vehicles passing the x mark on M11

7. Number of vehicles crossing over solid white line end of the verge hatching a

8. CCTV of Vehicles passing the X mark on M11

9. The number of unmarked police vehicles attending the scene without blue lights using hard shoulder.

10. Were there any accidents as a result of vehicles using the hard shoulder.

11. Time highway agency was called.

12. Was the highway agency instructed to close physically and display diversion signs?

13. How many diversion signs were displayed to prevent vehicles entering M11 or what was done to ensure vehicles do not enter m11.

reference. As this FOI request is relating to operational policing this
has been forwarded from the PFCC to Essex Police.

 

Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties
on public authorities. Unless exemptions apply, the first duty at Section
1(1)(a) is to confirm or deny whether the information specified in a
request is held.  The second duty at Section 1(1)(b) is to disclose
information that has been confirmed as being held.  Where exemptions are
relied upon Section 17 of FOIA requires that we provide the applicant with
a notice which: a) states that fact b) specifies the exemption(s) in
question and c) states (if that would not otherwise be apparent) why the

To disclose information relevant to this request would lead to a better
informed public demonstrating that Essex Police appropriately investigates
and responds to investigations. It may encourage individuals to provide
intelligence in order to assist investigations and reduce crime. There is
a public interest in the community being made aware of all the facts
relating to this area of policing in order to ensure complete openness and
transparency.

 

The public are also entitled to know how public funds are spent,
particularly in the current economic climate.

 

Factors against complying with Section 1(1)(a)

Modern-day policing is intelligence led and as stated within the harm,
Essex Police share information with other law enforcement agencies as part
of their investigative process. To disclose information to this request
could hinder the prevention and detection of crime as well as undermine
the partnership approach to investigations and law enforcement and the
health and safety of individuals.

 

Balancing Test

The Police Service relies heavily on the public providing information to
assist in investigations and has a duty to protect and defend vulnerable
individuals. The public has an expectation that any information they
provide will be treated with confidence and in line with the APP
Information Management Module. Anything which places that confidence at
risk, no matter how generic, would undermine any trust or confidence
individuals have in the Police Service. 

In addition Essex Police will not provide any further disclosure where
release of information may identify an individual and may breach the
individuals data protection rights, the exemption of Section 40 applies in
respect of this data.
